H Theevidencehereisthe[p]artieshavenotdisputedthis,neitherside,  p theyagreethatthevalueofthehouseandthemaritalpropertyisa  \ hundredandfifteenthousanddollars($115,000.00)andthemortgage H isapproximatelyseventyfivethousand($75,000.00).Thatleavesa 4 differenceoffortythousanddollars($40,000.00)inequity.Ofthe   fortythousanddollarsinequity[Wife]iscertainlyonewayoranother   entitledtogethertwentyninethousanddollars($29,000.00)back. '#&   WithallduerespecttoHusband,however,hisargumentthatthetrialcourttreatedWifes )$( contributionas separatepropertyseverelymissesthemarkandconfusestheissue.Thetrialcourt |*%) didnotfindthatWifesdownpaymentonthepurchaseofthepropertyautomaticallyentitledherto h+&* therepaymentof$29,000outofthenetequityinthispieceofmaritalproperty.Thetrialcourtheld  thattheproperty,subjecttothemortgage,wasapartofthenetmaritalestate,subjecttoequitable  divisionunderTenn.CodeAnn._ _Ԁ364121.Itthendetermined,afterevaluatingthefactorswith  respecttohowtodividemaritalproperty,thatWife,primarilyinrecognitionofhercontributionto t theacquisitionoftheproperty,wasequitablyentitledtothenetequityintheproperty.SeeTenn. ` CodeAnn._ _Ԁ364121(c)(5); Smith ,2004WL2094508,at*1_Ԅ*3._ԀSimplystated,thecourtfound, L  webelievecorrectly,thatthesubjectrealpropertywasamaritalasset;thatthemostsignificant 8  contributiontothepresentvalueofthenetequitywasWifesinitialcontributionof$29,000;andthat $ t Wifeshouldreceivethenetequitybywayofownershipofthemaritalrealproperty,subjecttothe  ` mortgage,asapartoftheoverallequitabledivisionofthenetmaritalestate.Giventhefactsofthis  L  case,wecannotsaythatthecourtbelowabuseditsdiscretioninitsdispositionofthemaritalreal  8  propertyandthesubjectdebtorintheoveralldivisionofthenetmaritalproperty. $  vS}  V.   /    Wiferequestsanawardof_attorneys_Ԁfeesonthisappeal,arguingentitlementtosuchan   awardbecauseofher verylimitedmeans,thefactthatHusbandsincomeismorethandoubleher p income,andbecausethisisthethirdtimeshe hashadtodefendwhatisessentiallyanequal \ propertydivision._Wife_Ԁpresentedthesamebasicargumentforattorneysfeesatthecourtbelow.
