Ðdoors€in€the€house€had€been€improperly€sealed,€that€two€windows€in€the€den€had€rotten€sills€and€wereÐ $X" Ðripe€for€future€water€intrusion,€that€no€kick€out€flashings€were€installed€on€the€roof€to€divert€waterÐ ô$D # Ðoff€the€EIFS€walls,€that€other€windows€also€had€rotten€wood,€and€that€several€penetrations€in€theÐ à%0!$ ÐEIFS€were€not€sealed€properly.€€The€purchasers€then€engaged€another€EIFS€contractor,€RichardÐ Ì&"% ÐMetzler€(ð ðMetzlerðð)€to€provide€an€additional€repair€estimate.€€The€Metzler€bid€indicated€total€repairsÐ ¸'#& Ðof€$46,856,€but€included€repairs€not€required€by€the€Stucco€Pro€report.€€Therefore,€the€ð ðas€isððÐ ¤(ô#' Ðappraisal€of€the€property€was€determined€to€be€$303,000.€€Ð )à$( Ðâ âÐ |*Ì%) Ðà  àAn€additional€inspection€and€report€by€architect€Roland€Taylor€(Mr.€Taylor),€the€ð ðTaylorÐ ° Ðâ âReport,ðð€was€consistent€with€the€Stucco€Pro€report€regarding€needed€repairs.€€Ms.€Holladay€did€notÐ œì Ðcontact€Speed€regarding€the€necessary€repairs,€but€had€the€repairs€recommended€by€Stucco€Pro€andÐ ˆØ ÐMr.€Taylor€completed€by€other€contractors.€€These€repairs€included€removing€sections€of€the€EIFSÐ tÄ Ðaround€all€exposed€windows€and€doors€and€above€the€garage€door;€adding€metal€flashing€to€all;Ð `° Ðinstalling€on€each€window€and€door€a€new€surround€of€EIFS€with€a€sloping€edge€at€the€top€to€preventÐ L œ Ðstanding€water;€installing€a€one„half„inch€wide€joint€between€the€new€surround€and€the€woodenÐ 8 ˆ Ðwindow€and€door€frames€and€caulking;€installing€kick€out€flashings;€and€repairing€rotten€woodÐ $ t Ðwindow€sills.€€On€July€15,€1999,€Mr.€Taylor€inspected€the€property€and€observed€that€the€final€repairsÐ  ` Ðwere€properly€completed.€€Ð ü L  ÐÌà  àDespite€the€completion€of€repairs,€the€purchasers€refused€to€close€and€demanded€the€returnÐ Ô$  Ðof€their€$5,000€in€earnest€money.€€Ms.€Holladay€filed€an€action€for€specific€performance€in€ShelbyÐ À  ÐCounty€Circuit€Court,€and€the€purchasers€counterclaimed€for€return€of€their€earnest€money.€€TheÐ ¬ü  Ðcircuit€court€entered€judgment€for€the€purchasers€and€awarded€them€attorneyððs€fees.€€AfterÐ ˜è  Ðcompleting€additional€repairs,€Ms.€Holladay€again€put€the€Asphodel€property€on€the€market.€€On€JulyÐ „Ô  Ð27,€2000,€the€sale€of€the€property€closed€at€a€purchase€price€of€$331,650.€€Ð pÀ ÐÌà  àIn€the€meantime,€on€December€21,€1999,€Ms.€Holladay€filed€a€complaint€in€Shelby€CountyÐ H˜ ÐChancery€Court€against€Charles€Speed€and€Charles€Speed€Contractor,€Inc.,€and€Sage€Contractors,Ð 4„ ÐInc.€€In€her€complaint,€Ms.€Holladay€alleged€breach€of€contract,€breach€of€warranty,€negligence,Ð  p Ðmisrepresentation,€violation€of€the€Tennessee€Consumer€Protection€Act,€and€breach€of€good€faith.׃×Ý ƒ #ÃÝòòÚ  Ú1Ú  ÚóóÝ  Ý×  ׀Р \ ÐShe€alleged€damages€in€the€amount€of€$15,000€and€ð ðother€damages,ðð€and€sought€punitive€damages,Ð øH Ðpre„judgment€interest,€and€attorneyððs€fees.€€Ð ä4 ÐÌà  àThe€cause€was€heard€in€December€2004€and€January€2005,€and€the€trial€court€entered€itsÐ ¼  Ðjudgment€on€March€28,€2005.€€After€making€complete€and€detailed€findings,€the€trial€courtÐ ¨ø Ðdetermined€Speed€had€breached€the€express€warranties€and€implied€warranties,€including€the€impliedÐ ”ä Ðwarranty€of€good€faith€and€fair€dealing,€by€failing€to€use€reasonable€care€to€ensure€the€AsphodelÐ €Ð Ðproperty€was€built€in€a€good€workmanlike€manner;€by€failing€to€build€it€to€accepted€homebuildingÐ l¼ Ðpractices;€by€failing€to€inspect€the€work€of€his€subcontractors;€by€failing€to€have€ð ðtrained€personnelððÐ X ¨ Ðinspect€the€property;€and€by€failing€to€ensure€the€manufacturerððs€specifications€regarding€EIFS€wereÐ D!” Ðfollowed.€€The€trial€court€determined,€however,€that€Speed€had€not€violated€the€Tennessee€ConsumerÐ 0"€  ÐProtection€Act.€€The€trial€court€awarded€Ms.€Holladay€damages€in€the€amount€of€$11,103.16€forÐ #l! Ðagainst€Mr.€Speed,€individually.€€In€her€brief€to€this€Court,€Ms.€Holladay€contends€that€Mr.€Speed,Ð „Ô  Ðas€an€individual,€contracted€for€the€sale€of€the€Asphodel€property.€€She€further€contends€that€Mr.Ð pÀ ÐSpeed€is€the€ð ðsole€shareholderðð€of€Speed€Contractors,€Inc.,€and€that,€under€the€multi„factor€testÐ \¬ Ðoutlined€in€òòOceanics€Schools,€Inc.€v.€Barbouróó,€112€S.W.3d€135€(Tenn.€Ct.€App.€2003),€the€corporateÐ H˜ Ðveil€of€Speed€Contractors,€Inc.€should€be€pierced.€€Ms.€Holladay€cites€to€no€proof€in€the€record,Ð 4„ Ðhowever,€demonstrating€that€any€of€the€òòOceanics€óófactors€exist€in€this€case.€€Further,€we€note€that,Ð  p Ðalthough€the€one€exhibit€to€which€Ms.€Holladay€cites€in€support€of€her€assertion€that€Mr.€Speed€actedÐ  \ Ðas€an€individual€and€not€in€his€corporate€capacity€arguably€could€support€such€a€determination,Ð øH Ðmultiple€additional€exhibits€in€the€record€demonstrate€otherwise.€€This€issue€is€without€merit.Ð ä4 ÐÌà  àWe€next€turn€to€whether€the€trial€court€erred€in€dismissing€Ms.€Ô_ÔHolladayÔ_Ôððs€claims€for€€breachÐ ¼  Ðof€contract,€negligent€and€intentional€misrepresentation,€and€negligence.€€The€primary€contentionÐ ¨ø Ðpresented€by€Ms.€Ô_ÔHolladayÔ_Ôððs€brief€regarding€this€issue,€as€we€perceive€it,€is€whether€the€trial€courtÐ ”ä Ðerred€in€its€determination€of€damages.€€Ms.€Holladay€asserts€she€is€entitled€to€amounts€expended€toÐ €Ð Ðmake€all€repairs€to€the€Asphodel€property€and€to€expenses€arising€from€her€contractual€obligationÐ l¼ Ðto€purchase€the€Gardenððs€Way€property€without€having€first€closed€on€the€Asphodel€property.€€Ð Ðdamages€include€reasonably€foreseeable€consequential€and€incidental€damages.€€òòId.óó€€In€this€case,Ð $X" Ðhowever,€even€assuming,€òòad€arguendoóó,€Speed€could€be€construed€to€have€breached€the€partiesððÐ ô$D # Ðcontract,€we€agree€with€the€trial€court€that€expenses€arising€from€Ms.€Ô_ÔHolladayÔ_Ôððs€contractualÐ à%0!$ Ðobligation€to€purchase€the€Gardenððs€Way€property€were€not€consequential€damages€arising€from€anÐ Ì&"% Ðalleged€breach€of€contract€by€Speed.€€Ms.€Holladay€is€a€licenced€attorney€and€experienced€home„Ð ¸'#& Ðbuyer.€€That€she€would€make€an€offer€to€buy€the€Gardenððs€Way€property€without€making€the€offerÐ ¤(ô#' Ðcontingent€on€the€sale€of€the€Asphodel€property€clearly€was€not€a€foreseeable€consequence€of€anyÐ )à$( Ðalleged€breach€of€contract€by€Speed.€€Further,€the€trial€court€found€Ms.€Ô_ÔHolladayÔ_Ôððs€testimonyÐ |*Ì%) Ðregarding€her€decision€to€purchase€the€Gardenððs€Way€property€without€a€contingency€to€be€notÐ h+¸&* Ðcredible.€€As€noted€above,€we€will€not€disturb€a€trial€courtððs€determination€on€matters€of€credibilityÐ ° Ðwithout€clear€evidence€to€the€contrary.€€We€find€no€such€evidence€in€this€case.€€Ð œì ÐÌà  àIf€the€trial€court€has€utilized€the€proper€measure€of€damages,€the€amount€of€damages€is€aÐ tÄ Ðquestion€of€fact€which€we€review€with€a€presumption€of€correctness.€€€òòBeaty€v.€McGrawóó,€15€S.W.3dÐ `° Ð819,€827€(Tenn.€Ct.€App.€1998).€€In€this€case,€the€trial€court€stated:Ð L œ ÐÌà8  à[a]lthough€the€[c]ourt€finds€that€Holladay€was€entitled€to€a€house€that€was€constructedÐ $ t Ðin€accordance€with€generally€accepted€construction€standards,€it€does€not€find€that€allÐ  ` Ðof€the€damages€she€seeks€were€a€direct€and€consequential€cause€of€the€repairs€sheÐ ü L  Ðultimately€made€to€the€property.€Ðè 8 Ð Ð  ÐÌÓÓThe€trial€court€also€noted:€€Ð À  ÐÓÓà8  àAs€stated€in€her€[Ms.€Ô_ÔHolladayÔ_Ôððs]€attorneyððs€letter€of€May€21,€1999,€to€the€LoweryððsÐ ˜è  Ð[potential€purchaser€of€Asphodel€property]€attorney:Ð„Ô Ð Ð  Ðà8  àÐ Ð Ð  Ðà8  àð ðIt€is€our€understanding€that€the€certified€EFIS€inspector€found€no€moisture€and€onlyÐ \¬ Ðrecommended€minor€repairs€and€minor€preventative€measures€to€ensure€no€futureÐ H˜ Ðdamage.ððÐ4„Ð Ð  ÐÌà8  àIn€a€followup€letter€of€June€11,€1999,€Ô_ÔHolladayÔ_Ôððs€counsel€writes:Ð \Ð Ð  ÐÌà8  àð ðMr.€Meltzerððs€(the€EFIS€inspector€for€the€Loweryððs€bank)€report€sent€to€VictoriaÐ ä4 ÐHolladay€has€been€reviewed.€It€is€ludicrous€to€believe€that€it€is€accurate€or€acceptable.ÐÐ Ð Ð  Ðà8  àà ` à.€.€.€Mr.€Sterling€(the€Stucco€Pro€inspector)€has€indicated€to€Ms.€Holladay€thatÐ ¼  Ðwith€the€exception€of€the€window€repairs€and€the€kick€out€flashings€on€the€roof€(sic),Ð ¨ø Ðall€other€items€in€his€report€are€ððpreventativeðð€and€not€repairs.ðð€€Ð”äÐ Ð  ÐÌThe€trial€court€observed:Ð l¼ ÐÌà8  àObviously,€the€Lowerys€became€reluctant€purchasers€and€were€attempting€to€haveÐ D!” ÐHolladay€make€extensive€repairs€to€the€property€that€she€didnððt€believe€wereÐ 0"€  Ðnecessary€or€required€by€the€contract.€€These€extensive€repairs€were€also€not€theÐ #l! Ðobligation€of€the€Defendant.€€Even€Holladay€thought€the€Lowerys€wereÐ $X" Ðoverreaching[.]€Ðô$D #Ð Ð  ÐÌà  àThe€trial€court€found€the€evidence€in€this€case€supports€an€award€of€damages€limited€to€theÐ Ì&"% Ðcost€of€EFIS€repairs,€window€and€roof€repairs€that€were€not€properly€corrected€by€Speed,€theÐ ¸'#& Ðreplacement€of€carpet€necessitated€by€the€leaking€roof,€the€painting€of€windows,€trim€and€walls€andÐ ¤(ô#' Ðthe€installation€of€kick€out€flashings€as€required€by€the€house€plans€and€supported€by€expertÐ )à$( Ðtestimony.€€Whether€attributable€to€breach€of€contract€or€breach€of€warranty,€the€evidence€does€notÐ |*Ì%) Ðpreponderate€against€the€trial€courtððs€determination€regarding€the€amount€of€actual€damages.Ð h+¸&* Їà  àWe€finally€turn€to€Ms.€Holladayððs€contention€that€the€trial€court€erred€in€dismissing€her€claimÐ ° Ðunder€the€Tennessee€Consumer€Protection€Act€(ð ðthe€Actðð)€as€codified€at€Tennessee€Code€AnnotatedÐ œì Ððð€47„7„101,€òòet€seqóó.€€The€Act€provides,€òòinter€aliaóó,€that€ð ð[r]epresenting€that€goods€or€services€are€ofÐ ˆØ Ða€particular€standard,€quality€or€grade,€or€that€goods€are€of€a€particular€style€or€model,€if€they€are€ofÐ tÄ Ðanotherðð€constitutes€an€unfair€or€deceptive€practice.€€Tenn.€Code€Ann.€ðð€47„18„104(b)(7)(2001).€Ð `° ÐAdditionally,€this€Court€has€held€that€an€unfair€or€deceptive€act€that€was€not€intentional€may€be€heldÐ L œ Ðto€qualify€as€a€violation€of€the€Act.€€òòE.g.,€Ingle€v.€Lilly€Constr.óó,€No.€E2004„02756„COA„R3„CV,Ð 8 ˆ Ð2005€WL€2051290,€at€*€8€(Tenn.€Ct.€App.€Aug.€26,€2005)€(òòno€perm.€app.€filedóó).€€As€we€noted€inòòÐ $ t ÐIngleóó,€the€Act€also€contemplates€negligent€conduct.€€òòId.óó€(citingòò€Smith€v.€Scott€Lewis€Chevrolet,€Inc.óó,Ð  ` Ð843€S.W.2d€9,€13€(Tenn.€Ct.€App.€1992)).€€The€Act€also€provides€that€the€court€may€award€trebleÐ ü L  Ðdamages€and€ð ðsuch€other€relief€as€it€considers€necessary€and€properðð€if€it€finds€that€the€employmentÐ è 8  Ðof€the€unfair€or€deceptive€act€was€a€willful€or€knowing€violation.€€Tenn.€Code€Ann.€ðð€47„18„Ð Ô$  Ð109(a)(3)(2001).€€Additionally,€Ð À  ÐÌà8  à[i]n€determining€whether€treble€damages€should€be€awarded,€the€trial€court€mayÐ ˜è  Ðconsider,€among€other€things:Ð„Ô Ð Ð  Ðà8  àà ` à(A)€The€competence€of€the€consumer€or€other€person;ÐpÀÐ Ð  Ðà8  àà ` à(B)€The€nature€of€the€deception€or€coercion€practiced€upon€the€consumer€orÐ \¬ Ðother€person;ÐH˜Ð Ð  Ðà8  àà ` àÔ_Ô(C)Ô_Ô€The€damage€to€the€consumer€or€other€person;€andÐ4„Ð Ð  Ðà8  àà ` à(D)€The€good€faith€of€the€person€found€to€have€violated€the€provisions€of€thisÐ  p Ðpart.Ð \Ð Ð  ÐÌTenn.€Code€Ann.€ðð€47„18„109(a)(4)(2001).Ð ä4 ÐÌà  àUpon€review€of€the€record€in€this€case,€we€believe€Ms.€Holladay€has€demonstrated€a€claimÐ ¼  Ðfor€violation€of€the€Act.€€It€is€undisputed€that€Speed€failed€to€inspect€the€EFIS€as€required,€that€heÐ ¨ø Ðhad€no€knowledge€of€EFIS€installation,€and€that€the€EFIS€was€not€installed€with€the€appropriateÐ ”ä Ðflashings.€€It€is€also€undisputed€that€Speed€failed€to€properly€repair€some€of€the€items€on€theÐ €Ð ÐAddendum€to€the€sales€contract.€€The€trial€court€found:Ð l¼ ÐÌà8  à[Mr.]€Speed€testified€that€he€had€never€built€a€house€of€EIFS€before€the€AsphodelÐ D!” ÐProperty,€and€only€once€since,€he€did€not€know€what€was€required€to€do€so,€he€did€notÐ 0"€  Ðknow€whether€there€were€any€differences€in€building€a€home€using€EIFS€and€otherÐ #l! Ðmaterials,€he€did€not€inspect€the€work€of€his€subcontractors,€he€gave€no€instructionsÐ $X" Ðto€his€subcontractors€with€regard€to€preparing€the€home€as€a[n]€EIFS€home,€and€heÐ ô$D # Ðdid€not€follow€the€architectural€plans.Ðà%0!$Ð Ð  ÐÌà8  à[Mr.]€Speed€admitted€that€neither€he€nor€anyone€in€his€organization€had€any€trainingÐ ¸'#& Ðin€construction€criteria€for€EIFS,€no€one€in€his€organization€inspected€the€AsphodelÐ ¤(ô#' Ðpropertyððs€EIFS,€and€he€had€no€knowledge€of€whether€or€not€the€EIFS€was€installedÐ )à$( Ðaccording€to€accepted€home€building€practices.Ð|*Ì%)Ð Ð  Ðà8  àÐh+¸&*Ð Ð  Ðà8  à[Mr.]€Speed€also€acknowledged€that€he€did€not€inquire€of€the€subcontractor€whoÐ ° Ðinstalled€the€windows€whether€the€subcontractor€had€any€knowledge€or€skill€as€toÐ œì Ðinstalling€windows€in€EIFS€or€even€whether€there€were€any€special€precautions€whichÐ ˆØ Ðshould€be€taken€in€that€installation.€[Mr.]€Speed€testified€that€he€did€not€know€if€theÐ tÄ Ðarchitectural€plans€for€the€Asphodel€property€called€for€flashing€in€certain€locationsÐ `° Ðor€whether€they€provided€any€special€instructions€relative€to€painting,€caulking€orÐ L œ Ðinstallation€of€windows€where€EIFS€was€used.€[Mr.]€Speed€also€admitted€that€he€didÐ 8 ˆ Ðnot€know€whether€there€were€any€special€criteria€for€caulking€where€EIFS€was€used,Ð $ t Ðand€he€gave€the€painter,€who€normally€did€the€caulking€as€he€painted,€no€specialÐ  ` Ðinstructions€about€caulking€the€EIFS.€€Speed€also€admitted€that€he€had€no€knowledgeÐ ü L  Ðof€whether€any€special€treatment€was€required€where€the€EIFS€and€brick€met€eitherÐ è 8  Ðat€the€time€the€Asphodel€property€was€built€or€thereafter.ÐÔ$ Ð Ð  Ðà8  àÐ Ð Ð  Ðà8  à[Mr.]€Speed€testified€that€the€only€step€he€took€to€ensure€the€EIFS€was€appliedÐ ¬ü  Ðproperly€was€to€hire€a[n]€EIFS€subcontractor€and€that€the€bid€from€Sage€ContractorsÐ ˜è  Ðto€apply€the€EIFS€did€not€include€any€reference€to€sealants€or€sealing€to€be€done€byÐ „Ô  Ðthem.ÐpÀÐ Ð  ÐÌà8  à[Mr.]€Speed€testified€that€he€purchased€the€architectural€plans€for€building€theÐ H˜ ÐAsphodel€property,€used€those€plans€to€obtain€the€appropriate€building€permits,€andÐ 4„ Ðmade€changes€to€those€plans,€but€obtained€no€modification€plans€from€thoseÐ  p Ðoriginally€drawn.Ð \Ð Ð  Ðà8  àÐ Ð Ð  Ðà8  àThe€architectural€plans€for€the€Asphodel€property€expressly€address€the€applicationÐ ä4 Ðof€EIFS€stating€ð ðContractor€to€follow€all€manufacturerððs€recommendations€andÐ Ð  Ðspecifications€to€provide€a€weatherproof€and€properly€performing€system€includingÐ ¼  Ðexpansion€and€control€joints€in€EIFS€as€per€manufacturerððs€instructions.ðð€[Mr.]€Ð ¨ø ÐSpeed€never€obtained€the€manufacturerððs€specifications€for€EIFS€as€used€in€theÐ ”ä ÐAsphodel€property.€€The€architectural€plans€call€for€flashing€about€all€doors€andÐ €Ð Ðwindows.€[Mr.]€Speed€disagreed€with€both€the€architect€who€drew€the€plans€andÐ l¼ ÐTaylor€about€whether€flashing€was€needed.€€ÐX ¨Ð Ð  ÐÌà  àThe€trial€court€also€noted€that€Mr.€Taylor€testified€that€the€EFIS€installation€and€lack€ofÐ 0"€  Ðflashing€did€not€meet€residential€construction€industry€standards;€that€the€caulking€andÐ #l! Ðweatherproofing€were€not€consistent€with€construction€standards;€that€without€the€flashing€shownÐ $X" Ðon€the€plans,€the€house€was€incomplete;€that€leaving€the€flashing€off€would€affect€the€EFIS€system;Ð ô$D # Ðthat€the€standards€had€not€changed€in€the€past€ten€to€fifteen€years€and€that€it€was€and€is€inappropriateÐ à%0!$ Ðto€leave€out€flashing€and€caulking€when€installing€EFIS.€€The€trial€court€found€that€Mr.€TaylorððsÐ Ì&"% Ðtestimony€and€report€were€consistent€with€the€Stucco€Pro€report€as€to€the€repairs€required€to€bringÐ ¸'#& Ðthe€EIFS€up€to€industry€standards.Ð ¤(ô#' ÐÌà  àAdditionally,€John€R.€Whalum,€III,€(Mr.€Whalum)€the€owner€of€Sage€Contractors€and€anÐ |*Ì%) Ðapproved€EIFS€applicator,€testified€that€Mr.€Speed€did€not€give€him€a€copy€of€the€construction€plansÐ h+¸&* Ðfor€the€Asphodel€property€and€that€Mr.€Speed€designated€the€areas€where€he€wanted€the€EFISÐ ° Ðapplied.€€He€also€testified€that€Mr.€Speed€never€asked€him€about€installing€flashing€or€applyingÐ œì Ðsealants,€and€that€his€quote€was€for€application€only€and€did€not€include€the€installation€of€flashing,Ð ˆØ Ðcaulking€or€sealants.€€Mr.€Whalum€further€testified€that€step€flashing€has€always€been€required€forÐ tÄ ÐEFIS.€€Ð `° ÐÌà  àIn€sum,€despite€having€no€experience€with€or€knowledge€of€EIFS€installation,€Mr.€SpeedÐ 8 ˆ Ðfailed€to€review€the€EIFS€manufacturerððs€recommendations€and€changed€the€architectural€plans,Ð $ t Ðremoving€flashings€that€were€required€by€both€the€plans€and€industry€standards.€€He€assured€Ms.Ð  ` ÐHolladay,€however,€that€the€Asphodel€property€had€been€ð ðconstructed€in€accordance€with€acceptedÐ ü L  Ðhomebuilding€practicesðð€and€that€it€had€been€ð ðinspected€by€.€.€.€trained€personnel.ðð€€It€was€not.Ð è 8  ÐÌà  àIt€is€clear€to€this€Court€that€the€foregoing€constitutes€a€deceptive€act€for€the€purposes€of€theÐ À  ÐTennessee€Consumer€Protection€Act.€€Had€Speed€merely€relied€on€the€approved€architectural€plansÐ ¬ü  Ðand€the€expertise€of€Sage€Contractors€for€the€appropriate€EIFS€installation,€the€deceptive€act€arguablyÐ ˜è  Ðcould€be€characterized€as€negligent€and€not€intentional.€€However,€in€light€of€Mr.€SpeedððsÐ „Ô  Ðmodification€of€the€plans€and€removal€of€the€flashings€without€architectural€approval,€withoutÐ pÀ Ðwarranty€by€expert€installers€that€installation€without€flashings€would€not€be€contrary€to€acceptedÐ \¬ Ðpractices,€and€in€contradiction€of€the€manufacturerððs€recommendations,€Mr.€SpeedððsÐ H˜ Ðmisrepresentations€regarding€the€standard€and€quality€of€the€Asphodel€property€constitute€anÐ 4„ Ðintentional€deception€under€the€Act.€€We€accordingly€reverse€the€trial€courtððs€dismissal€of€Ms.Ð  p ÐHolladayððs€claims€under€the€Tennessee€Consumer€Protection€Act.€€€Ð  \ ÐÌà  àAn€award€of€treble€damages€under€ðð€47-18-109(a)(3)€for€an€intentional€violation€of€the€ActÐ ä4 Ðis€permissive.€€Such€an€award€depends€upon€the€facts€of€each€case.€€òòWilson€v.€Eschóó,€166€S.W.3d€729,Ð Ð  Ð731€(Tenn.€Ct.€App.€2004).€€In€determining€whether€to€award€treble€damages,€the€trial€court€mayÐ ¼  Ðconsider,€among€other€things,€the€factors€enumerated€in€ðð€47„18„109(a)(4).€€The€determination€ofÐ ¨ø Ðwhether€an€award€of€treble€damages€is€appropriate€lies€within€the€sound€discretion€of€the€trial€court.€Ð ”ä ÐòòId.€€óóAdditionally,€under€Tennessee€Code€Annotated€ðð€47„18„109(e)(1),€the€trial€court€may€awardÐ €Ð Ðreasonable€attorneyððs€fees€and€costs€upon€a€finding€of€a€violation€of€the€Act.€€Because€the€trial€courtÐ l¼ Ðhas€not€exercised€its€discretion€under€ðð€47„18„109(a)€(3)€or€(e)(1),€we€remand€for€consideration€of€Ð X ¨ Ðwhether€an€award€of€treble€damages€and€an€award€for€attorneyððs€fees€and€costs€to€Ms.€Holladay€areÐ D!” Ðjustified€in€light€of€Speedððs€violation€of€the€Act.Ð 0"€  ÐÌòòò òÓ€ O !"#$%&(ÿÿ03ÓÓ?+° °` ¸ hÀpÈ xÐ °œX?ÓÓ  ÓHolding€ó óóóÐ $X" ÐÓ.¢ÓÌà  àWe€remand€this€matter€for€further€proceedings€consistent€with€this€opinion.€€Costs€of€thisÐ Ü%,!$ Ðappeal€are€taxed€to€the€Appellee,€Charles€Speed€Contractors,€Inc.Ô#†X éXXX éàY#ÔÐ È&"% ÐÌÌÌà  àà ` àà ¸ àà  àà h àà À àà  à___________________________________€Ð x*È%) Ðà  àà ` àà ¸ àà  àà h àà À àà  àDAVID€R.€FARMER,€JUDGE
