571.01     Definitions

(a) “Airports” means all property comprising Cleveland Hopkins International Airport, Burke Lakefront Airport and all airports owned and operated by the City.

(b) “Airport Management” means the Director of Port Control or his duly authorized representative.

(c) “Airport Security Program” means the comprehensive plan for security requirements and procedures at Cleveland Hopkins International Airport, including rules, regulations, and procedures for the issuance, display, use, and return of identification badges, as that plan is approved by the Transportation Security Administration or its equivalent (“TSA”).

(d) “Control tower” means the agency assigned to the actual control of air traffic at each individual airport.

(e) “Person” means any individual, firm, copartnership, corporation, company, association or agency.

(f) “Secured Area” means the Security Identification Display Area, Air Operations Area, or sterile areas at Cleveland Hopkins International Airport, as those areas are defined by the TSA.

571.02     Aviation Fuel and Lubricant Rates

Effective July 1, 1975, all persons, firms or corporations engaged in the sales of aviation fuel and lubricants directly or indirectly, from or at a Municipally owned airport facility of the City to transient or based aircraft owners and/or operators, shall pay the City a fee for the privilege and right to make such sales from the airport premises. The fee shall be based upon and for the quantities of aviation fuel and lubricants delivered to the premises or facilities of such person, firm or corporation for sale from and at its airport premises and shall be at the following rates:

The Director of Port Control may at any time increase or decrease aviation fuel and lubricant fee rates, subject to the prior approval of the Board of Control.

571.021     Service Providers at Cleveland Hopkins International Airport

All entities, including Scheduled Airlines that provide services to other Scheduled Airlines, other than those airlines that are signatories, or majority-owned subsidiaries of signatories, to the Agreement and Lease authorized by Ordinance No. 1585-A-76, passed August 16, 1976, or signatories of a lease, lease by way of concession or other agreement that exempts them from such fees, that provide services at Cleveland Hopkins International Airport, including, but not limited to services related to ground handling, cargo handling, fueling aircraft, fueling ground equipment, aircraft maintenance, ground vehicle maintenance, interior and exterior aircraft cleaning, catering, deicing, and laboratory services for aircraft, shall pay Cleveland Hopkins International Airport a fee of seven percent (7%) of gross revenues derived from providing those services for the privilege of providing such services at Cleveland Hopkins International Airport.

The Director may, at any time, increase or decrease the percentage fee authorized herein, subject to prior authorization of Cleveland City Council.

571.03     Violation of Rules and Regulations

Any person operating or handling aircraft, or operating any vehicle, equipment or apparatus on the Airport, or using any of the Airport facilities in violation of any Federal or State law, or in violation of the following rules and regulations, shall be prosecuted or deprived of further use of Airport facilities for such length of time as may be determined by the Commissioner of Airports, or both. It will be assumed upon entrance of any person upon Airport property, that such person has agreed to observe all such rules and regulations.

571.04     Removal of Property

No person shall remove or use any aircraft, aircraft parts, motor vehicles or tools owned by any other person while such aircraft, aircraft parts, motor vehicles or tools are on the Airport or within its hangars, without presenting the written consent of the owner or other satisfactory evidence of the right to same to the Airport Management.

571.05     Payment of Fees and Charges

No person shall refuse or attempt to evade payment of any fees or charges as established, for use of Airport facilities. All such fees and charges shall be payable in cash unless satisfactory credit arrangements have been made in advance.

571.06     Restricted Areas

No person shall enter any area posted as being closed to the public with the exception of:

(a) Airport personnel assigned to duty within;

(b) Persons authorized by the Airport Management;

(c) Passengers entering such area for the purpose of embarkation or debarkation.

571.061     Identification Badges

(a) The Director of Port Control or the Director's designee shall be authorized to issue and revalidate identification badges in accordance with the rules, regulations, and directives (collectively, “Regulations”) of the Transportation Security Administra tion or its equivalent (“TSA”).

(b) An identification badge issued by the Director of Port Control or the Director's designee shall be possessed and displayed in accordance with TSA Regulations and the Airport Security Program. Identification badges shall be of a design and contain such information as is determined by the Director of Port Control in accordance with TSA Regulations.

(c) Any person with an identification badge issued under division (a) of this section shall return the badge to the Department of Port Control within twenty-four (24) hours of a determination by the Director of Port Control or the Director's designee that the person no longer has access to a Secured Area at the Airport. The reasons for this determination include, termination or suspension from employment; change in duties of employment; breach, termination or expiration of a City contract; and any additional reasons as set forth in TSA Regulations or in the Airport Security Program.

(d) The Director of Port Control or the Director's designee may assess and collect fees or charges related to Secured Area identification badges in accordance with the following schedule:

(1) Fifty Dollars ($50.00) for the replacement of a lost or missing badge;

(2) One Hundred Dollars ($100.00) for any badge not returned to the Department of Port Control within twenty-four (24) hours of a determination that a person no longer has access to a Secured Area at the Airport under division (c) of this section;

(3) One Hundred Dollars ($100.00) for any person who does not properly obtain an identification badge upon being hired as an employee required to work within a Secured Area, or revalidate an identification badge within the period required by TSA Regulations;

(4) Twenty-five Dollars ($25.00) for any person who commits a first violation, involving an identification badge, of TSA Regulations or the Airport Security Program; and

(5) Fifty Dollars ($50.00) for any person who commits a second violation within twelve (12) months of a first violation, involving an identification badge, of TSA Regulations or the Airport Security Program.

(e) Airport tenants, contractors and subcontractors, and any person or entity that has been issued a Secured Area identification badge, shall be responsible for assuring the compliance of their officers, employees, agents, contractors, and subcontractors with the requirements of this section, TSA Regulations, and the Airport Security Program, and shall be responsible for the payment of any fees and charges assessed against those persons and entities under division (d) of this section.

571.062     Fingerprinting

(a) The Director of Port Control or the Director's designee shall be authorized to fingerprint Secured Area Access Persons and process all fingerprints under the rules, regulations, and directives (collectively, “Regulations”) of the Transportation Security Administration, successor entity to the FAA, or its equivalent (“TSA”).

(b) The Director of Port Control or the director's designee may assess and collect fees or charges (collectively, “Fees”) related to fingerprinting under the following schedule:

(1) A charge to reimburse the City for its cost as set by the TSA, to electronically transmit the fingerprints of each Secured Area Access Person to the Aviation Security Clearinghouse, or its equivalent, to transmit the fingerprints to the Federal Bureau of Investigations to perform a criminal-history record check;

(2) A reasonable administrative fee, to be determined in writing by the Director or the Director's designee, to reimburse the City for additional administrative costs incurred to fingerprint Secured Area Access Persons and process all such fingerprints.

(c) City employees and Airport volunteers shall be exempt from the Fees set forth in division (b) of this section.

571.07     Soliciting of Funds

No person shall solicit funds for any purpose while on the Airport, unless prior approval has been received from the Airport Management.

571.08     Advertisements

No person shall post, distribute or display signs, advertisements or circulars without prior approval of the Airport Management, and only in such manner as may be prescribed.

571.09     Photography

No person shall take still, sound or motion pictures for commercial use while on the Airport without the approval of the Airport Management.

571.10     Property Damage

Any and all Airport property destroyed or damaged, by accident or otherwise, shall be paid for by the party responsible.

571.11     Accidents; Reports

Participants and witnesses of any accident occurring on Airport property shall make a full report of same to the Airport Management with names and addresses of parties concerned, at the first opportunity.

571.12     Animals

No person shall enter the Terminal Building with a dog or other animal with the exception of properly leashed dogs that aid individuals with disabilities, or animals to be transported by air that are properly confined. Dogs and other animals will be permitted in areas other than the Terminal Building which are open to the public, provided that such are properly leashed or confined in such a way as to be under full control.

571.13     Vehicles for Hire

No person shall operate any vehicle for hire carrying passengers, unless such operation has been approved by the Airport Management and subject to such terms and conditions as may be prescribed.

571.14     Lost Articles

Any person finding lost articles shall deposit them with the office of the Airport Management.

571.15     Commercial Activities

No person shall use the Airport for conducting revenue-producing activities without securing an appropriate permit for such activity and the approval of the Airport Management.

571.16     Sanitation

No person shall deposit garbage, waste paper or other refuse except in receptacles provided for that purpose.

571.17     Use of Roads and Walks

(a) No person shall occupy any walk or roadway in such a way as to hinder or obstruct the use of the same by other traffic.

(b) No person shall travel upon the Airport other than on walks, roadways or other areas provided for the particular class of traffic.

571.18     Disorderly Conduct

No person shall commit any disorderly, obscene, indecent or unlawful act while on the Airport.

571.19     Gambling

No person shall indulge in or operate any form of gambling while on the Airport.

571.20     Firearms and Explosives

No person except duly authorized persons, peace officials, Federal, Airport and air carrier employees, or members of the armed forces of the United States on official business, shall carry any firearms or explosives on the Airport without the written permission of the Airport Management. All other persons shall turn over such firearms or explosives to the office of the Airport Management or to the patrolman on duty.

571.21     Smoking near Flammables

No person shall carry a lighted cigarette, pipe, cigar or any object with an open flame within fifty feet of any aircraft, gasoline truck or area containing or housing flammable fluids.

571.22     Tampering with Equipment

No person shall tamper with or maliciously destroy any part of the Airport or any of the equipment thereon.

571.23     Airport Liability

The Airport Management and the City shall not be liable for any injuries, damage or loss to persons or property as a result of any accident, mishap or incident of any nature whatsoever or from any cause whatsoever to any individual, aircraft or property, occurring on the Airport or in the use of the Airport facilities.

571.24     Traffic Rules

No person shall operate any mobile vehicle on the Airport in violation of the rules and regulations governing the operation of mobile vehicles in the State, and as established by the Airport Management.

571.25     Operating Vehicle or Equipment when Intoxicated

No person shall be permitted to operate any mobile vehicle or equipment on the Airport while under the influence of any habit forming drug, narcotic or intoxicating liquor.

571.26     Careless Vehicle Operation

No person shall operate any mobile vehicle on Airport roadways or in parking areas in a careless or negligent manner, or at a speed or in a manner which endangers or is likely to endanger persons or property, or in disregard of the rights and safety of others.

571.27     Dangerous Vehicles

No person shall operate any mobile vehicle on the Airport if such vehicle is so constructed, equipped or loaded as to be a danger, or is likely to endanger persons or property.

571.28     Speed Limits

Mobile vehicles shall be operated in strict compliance with the speed limits established by the Airport Management, for the area in which the vehicle is being operated, and shall not at any time exceed a speed of twenty-five miles per hour.

571.29     Vehicle, Equipment Operation in Restricted Areas

No person shall operate any mobile vehicle or equipment on the aircraft loading ramp, aircraft landing area, taxiways or beyond the hangar line, with the exception of:

(a) Persons assigned to duty therein, or

(b) Persons with authorization of the Airport Management.

571.30     Passenger Loading Gate Area

No mobile vehicle will be permitted within the confines of the passenger loading gate area unless authorization has been received from the Airport Management.

571.31     Speed Limits in Restricted Areas

Operators of mobile equipment on the inner taxiway, aircraft loading ramp and aircraft parking areas shall operate such equipment with extreme caution, and shall not at any time exceed a speed of fifteen miles per hour.

571.32     Obstructions in Gate Area

No person shall park or place any mobile vehicle, equipment or apparatus within the aircraft loading area in such a way or manner as to bar or obstruct the area to parking aircraft.

571.33     Mobile Vehicles or Equipment in Loading Area

No person shall operate any mobile vehicle or equipment in such a manner as to pass between the passenger loading gates and aircraft parked in the gate area.

571.34     Obstruction to Emergency Equipment

No mobile equipment, vehicle or apparatus shall be placed on any roadway, driveway, hangar ramp or other area in such a manner as to obstruct the passage of emergency or snow removal equipment.

571.35     Vehicle Operator's License

No person shall operate any mobile vehicle on the Airport unless such person possesses a valid operator's license issued by the state of residence or by the Airport Management.

571.36     Speed Limit in Passenger Gate Area

Persons operating mobile vehicles within the confines of the passenger gate area shall use extreme caution and shall not exceed a speed of ten miles per hour at any time.

571.37     Parking Areas

No person shall park a mobile vehicle in any area other than that area designated for the parking of vehicles and in such manner as may be prescribed.

571.38     Parking Time Limits

No person shall park any mobile vehicle in excess of the time limit established, or in reserved or restricted areas unless instructed to do so by authorized personnel.

571.39     Vehicle Lights

All mobile vehicles, except motorcycles, operated on the Airport between the hours of sunset and sunrise, shall be equipped with two headlights and one or more tail lights, the headlights to be of sufficient brilliance to insure safe operation at night. Lights shall be on at all times during the hours of darkness that the vehicle is being operated, and when parked in such areas that it constitutes a hazard to Airport operation.

571.40     Abandoned Vehicles

No person shall abandon any vehicle on Airport property.

571.41     Traffic Signs

Operators of mobile vehicles on the Airport shall observe and comply with all traffic signs and signals.

571.42     Pedestrian's Right of Way

Pedestrian traffic shall have right of way over all vehicular traffic while on the Airport.

571.43     Loading Area Use

No mobile vehicle, private or commercial, shall load or unload in any area other than that designated for such purpose.

571.44     General Aeronautical Rules

No person shall navigate any aircraft, land upon, fly the same from, service, maintain, repair any aircraft or conduct any aircraft operations on or from the Airport in any manner not in conformity with current Federal Civil Aeronautics Administration and Civil Aeronautics Board rules and regulations and the following rules and regulations established by the Airport Management.

571.45     Taxi and Traffic Patterns

All pilots operating from the Airport shall be required to know and observe all taxi and traffic patterns established by the control tower.

571.46     Brakes and Radio Receivers

All aircraft landing at, or departing from, the Airport shall be equipped with a radio receiver, capable of receiving instructions from the control tower, and brakes in good operating condition.

571.47     Practice Area

All students and instructors operating in the practice area of the Airport shall maintain a listening watch on the control tower frequency at all times while within the area.

571.48     Blocking Aircraft Prior to Engine Runup

No aircraft engine shall be started or allowed to run unless a certified pilot or mechanic is attending the controls. Blocks or other suitable means of blocking the aircraft shall be placed in front of the main landing wheels before starting any engine, unless the aircraft is equipped with a suitable parking brake.

571.49     Operator's Certificate

No person shall operate any aircraft on the Airport unless that person has in his immediate possession an appropriate certificate, issued in his name, authorizing such control of aircraft, and the permission of the owner.

571.50     Tail Skids

No person shall land or take off any aircraft equipped with a tail skid or device other than a nose or tail wheel unless authorized by the Airport Management.

571.51     Acrobatics

No aircraft shall be flown within the control zone of the Airport in any manner other than required for normal, routine operation.

571.52     Practice Night Landings

All pilots desiring to use the facilities of the Airport for practice night landings shall obtain prior approval from the Airport Management and the control tower. All aircraft used in such operation shall be equipped with two-way radio.

571.53     Careless Operation

No person shall operate any aircraft on the aircraft landing area, aircraft ramp and parking areas or taxiways in a careless or negligent manner, or at a speed or in a manner that endangers or is likely to endanger persons or property, or in disregard of the rights and safety of others.

571.54     Aircraft Parked on Taxiway

No aircraft shall be parked or placed on any taxiway or in any area in such a way or manner as to obstruct or prohibit the safe operation of other aircraft, or prevent the passage of emergency equipment.

571.55     Time Limits in Gate Area

No aircraft shall be parked in the passenger gate area in excess of the time limit established except under the conditions covering charges for excessive time in the gate area.

571.56     Single Engine Aircraft in Gate Area

Operators of single engine aircraft desiring to use the gate area for loading or unloading passengers shall obtain permission from the Airport Management and the control tower.

571.57     Unsafe Areas

No aircraft shall use any portion of the aircraft landing area or taxiways considered unsafe for the operation of such aircraft. Such areas shall be marked with red flags by day and flares at night or notice shall be given to the control tower, or both.

571.58     Registration and Use Charges for Transient Aircraft

All operators of transient aircraft are required to register the arrival of their aircraft with the office of the Airport Management. All operators of aircraft shall pay the fee for Airport use before departure clearance will be given. All such fees shall be payable in cash unless prior credit arrangements have been made.

571.59     Improperly Parked Aircraft

Upon direction of the Airport Management, the owner or operator, or his agent, of any aircraft parked or stored on the Airport shall move the aircraft from the area in which it is parked or stored to such area as may be designated by the Airport Management. Should the owner, or his agent, fail to comply with such directive, the Airport Management shall have the aircraft towed to the specified area at the owner's expense, without assuming liability for damage that may result in the course of such moving.

571.60     Aircraft Parking in Designated Areas

No person shall park, or cause to be parked, any aircraft in any area other than that designated for the purpose.

571.61     Aircraft Parked at Night

In the event that it becomes necessary for any aircraft to be parked on a taxiway, or within 500 feet of the center line of a runway during the hours of darkness, it will be the responsibility of the owner or operator to provide a means of outlining the aircraft as an obstruction, in the form of navigation lights or a suitable substitute. The owner or operator shall be held responsible for any damage resulting from failure to do so.

571.62     Control Tower Clearance

Operators of aircraft shall not take off, taxi or land at the Airport without proper clearance from the control tower, except in emergencies.

571.63     Removal of Disabled Aircraft

The owner, operator or agent shall be responsible for the prompt removal of disabled aircraft and aircraft parts from the landing area, unless instructed otherwise for the purpose of investigation as a result of accidents.

571.64     Visual Traffic Signals

All pilots operating from the Airport shall be familiar with current regulations regarding visual traffic signals.

571.65     Ground Instructions

Pilots shall follow all instructions issued by the Airport Management and the control tower while operating on the Airport.

571.66     Engine Warmup

Aircraft engines shall not be warmed up or run in any area other than that designated for the purpose.

571.67     Radio Contact

All radio contacts between pilots of aircraft and the control tower shall be conducted in strict accordance with standard procedures and phraseologies as established by the Federal Civil Aeronautics Administration and the Federal Communications Commission.

571.68     Simulated Emergencies

No operator of an aircraft shall simulate an emergency while within the control zone, unless the control tower and the Airport Management have been notified in advance.

571.69     Restricted Aircraft

No person shall operate any aircraft on the Airport if such aircraft is so constructed, equipped or loaded as to be a danger, or is likely to endanger persons or property.

571.70     Cleaning of Aircraft

No person shall use flammable volatile liquids in the cleaning of aircraft, aircraft engines, propellers, and appliances unless such cleaning operations are conducted in open air, or in a room specifically set aside for that purpose, which room must be properly fireproofed and equipped with adequate and readily accessible fire extinguishing apparatus.

571.71     Open Flame Operation

No person shall conduct any open flame operation in any hangar, or on the Airport grounds, or part thereof unless specifically authorized to do so by the Airport Management.

571.72     Fire Hazards

No person shall store or stock material or equipment on the Airport in such a manner as to constitute a fire hazard.

571.73     Storage of Flammable Materials

No person shall keep or store any flammable liquids, gases, signal flares or other similar equipment in the hangars or in the buildings on the Airport, provided that such material may be kept in an aircraft in the proper receptacles installed in the aircraft for that purpose, or in rooms or areas specifically approved for such storage by the Airport Management.

571.74     Lubricating Oils

No person shall keep or store lubricating oils in or about the hangars, provided that such material may be kept in aircraft in the proper receptacles provided for that purpose or in containers provided with suitable draw-off devices.

571.75     Waste Receptacles

Lessees of hangars shall provide suitable metal containers with self-closing covers for the storage of oily rags, waste and other rubbish.

571.76     Smoking in Prohibited Areas

No person shall smoke in any hangar or shop or in any building, room or place on the Airport where it is specifically prohibited by the Airport Management.

571.77     Cleaning Fluids

No person shall use volatile flammable substances for the cleaning of floors in the hangars or in other buildings of the Airport.

571.78     Doping

Doping processes shall be conducted only in properly designated, fireproofed and ventilated rooms and buildings.

571.79     Fire Apparatus

All tenants or lessees of hangars or shop facilities shall supply and maintain such adequate and readily accessible fire extinguishers and fire equipment and provide for such periodic fire drills as may be prescribed.

571.80     Burke Lakefront Airport

(a) Burke Lakefront Airport is open only during daylight hours and operates under Visual Flight Rule conditions.

(b) No aircraft shall be operated in such a manner as to pass over Cleveland Municipal Stadium at any time.

(c) All aircraft operating from the Airport shall make their turn after take off in such a manner that the Airport shall be between the aircraft and the City.

(d) All aircraft operating in the traffic pattern at the Airport shall operate in such a manner as to fly between the breakwall and the active runway, over the water, on the downwind leg of the pattern.

(1) Southwest traffic pattern: right hand.

(2) Northeast traffic pattern: left hand.

571.81     Additional Regulations

The Commissioner of Airports is hereby authorized to make such other or further regulations not inconsistent with the foregoing as may be deemed necessary. All such regulations shall become effective within ten days after publication in the City Record.

571.82     Controlled Areas

(a) Except as provided in division (b) of this section, no person shall knowingly enter or remain in an area the use of which is controlled by a screening device under a security program required and approved by the Federal Aviation Administration without submitting to a search of his or her person or property by the approved screening device and/or the attending security person or law enforcement officer for the purpose of deterring or preventing the carrying aboard airplanes of any explosive, incendiary device or a deadly or dangerous weapon.

(b) The provisions of division (a) of this section do not apply to those individuals and groups specifically identified in the Airport Security Master Program, as approved by the Federal Aviation Administration.

(c) Whoever violates this section is guilty of a misdemeanor of the second degree.

571.83     Letters of Agreement with Federal Aviation Administration

The Director of Port Control is hereby authorized to enter in Letters of Agreement with the Federal Aviation Administration ("FAA"), its successors in interest or instrumentalities, including specifically the FAA tower and/or the FAA Flight Service Station ("FSS") at Burke Lakefront and/or Cleveland Hopkins International Airport, with respect to the following subjects only:

(a) Airport emergency service;

(b) Operation of airport lighting;

(c) Reporting airport conditions;

(d) Control of vehicular traffic on airport movement areas, including a hold harmless clause where appropriate;

(e) Operations under an exemption from the Federal Aviation Regulations concerning the Control Zones within which special VFR weather minimums are not authorized; and

(f) Other similar agreements involving airport operations, which require coordination between the City and Tower or FSS.

Except as a result of the hold harmless clause authorized in paragraph (d), such Letters of Agreement may not authorize or obligate the City to expend money. Copies of said letters of agreement shall be filed with the Council.

571.84     Tie Down Spaces_Burke Lakefront Airport

The Commissioner of Burke Lakefront Airport is authorized to enter into permit agreements for use and occupancy of aircraft tie-down spaces at Burke Lakefront Airport, provided that the term of such agreement shall not exceed one (1) year. The Commissioner of Burke Lakefront Airport shall fix the rental for such tie-down spaces.

571.85     Fees for Aircraft Parking on City-controlled Ramp Areas

The Director of Port Control is hereby authorized to charge and collect a fee for the parking of aircraft on City-owned and operated ramp areas at Cleveland Hopkins International Airport and Burke Lakefront Airport. The fees authorized herein shall be fixed by the Director of Port Control in such amounts as deemed appropriate by said director, and as approved by the Board of Control. Such fees shall be reviewed and set annually by the Board of Control.

571.86     Fuel Trucks; Permit and Inspection Required

(a) No person shall operate a fuel truck at Cleveland Hopkins International Airport or Burke Lakefront Airport without a permit issued by the Director of Port Control.

(b) No permit shall be issued pursuant to division (a) of this section until the fuel truck passes inspection conducted by the Department of Port Control, ensuring compliance with all relevant state and federal laws, and FAA rules and regulations.

(c) The fee for such permit is $75.00. The permit is good for one year from the date of issuance. Upon expiration, an inspection must occur before another permit is issued.

(d) Whoever violates this section is guilty of a minor misdemeanor and shall be fined one hundred dollars ($100.00).

571.87     Fuel Trucks_Fines for Spills of Hazardous Materials

(a) The Director of Port Control is authorized to assess a fine against the owner of any fuel truck involved in a spill of its hazardous contents on Airport grounds, when such spill is caused by a malfunctioning or damaged fuel truck.

(b) The fine shall be twenty-five dollars ($25.00) for the first such fuel spill, fifty dollars ($50.00) for the second spill, and one hundred dollars ($100.00) for the third spill, if such subsequent spills are caused by failure to correct the problem in the fuel truck which caused the original spill.

571.88     Use of and Rental Fee Schedule for Meeting Room Space at Burke Lakefront Airport and Cleveland Hopkins International Airport

(a) Airport Management may rent meeting room space at the Airports to private Persons provided that such Persons pay the fees authorized in division (c) of this section and that the space is required for no greater than seventy-two (72) consecutive hours, and has an estimated rental cost of no greater than Twenty-Five Thousand Dollars ($25,000).

(b) Airport Management may permit the following public parties to use meeting room space at the Airports at no cost provided that the meeting room space will not be used to raise money for political campaigns or political issues:

(1) Branches, departments or offices of the City of Cleveland if the use furthers the functions or goals of that branch, department, or office.

(2) Non-profit organizations and neighborhood organizations located in the City of Cleveland, including block clubs, street clubs, and ward clubs, if the use is to provide social services, including direct health and welfare services to individuals, or to address safety, building, or housing issues.

(3) Schools located in the City of Cleveland if the use furthers an educational or recreational purpose.

(c) Airport Management shall assess and collect fees for the rental of meeting room space at the Airports according to a Rental Fee Schedule, which Rental Fee Schedule shall be set by the Board of Control.

571.99     Penalty

(a) Whoever violates any provision of this chapter, for which no other penalty is provided, shall be fined not more than fifty dollars ($50.00), or imprisoned not more than thirty days, or both.

(b) Whoever violates Section 571.06 shall be fined not more than five hundred dollars ($500.00) and imprisoned not more than six months, or both.
