As used in this chapter:
(a) "Sewage" means the water or waterborne wastes, and "industrial wastes" means the liquid wastes resulting from any commercial manufacturing or industrial operation or process, which waterborne or liquid wastes enter the system of sewerage or any portion thereof of the City from any premises having a connection therewith or thereto.
(b) "Water pollution" means the placing of any noxious or deleterious substance in or upon any watercourse, river, stream or lake bounding upon or within the City which renders the waters harmful or inimical to the public health, or to animal or aquatic life, or to the use of such waters for domestic water supply or for recreation.

(b) Homesteads owned by a person sixty-five (65) years of age or older whose total annual income does not exceed the limits listed below or homesteads owned by a person permanently and totally disabled whose total annual income does not exceed the limits listed below may be eligible for the special homestead rate established under division (a) of this section, provided the owner has obtained approval by their county of residence of a reduction in taxes under the Homestead Exemption provisions of Chapter 323 of the Revised Code. The Director of Public Utilities shall prescribe the application form for the homestead rates and have final approval of all applications.

(c) The sewerage service charges within the City shall be increased to meet the funding requirements of the Ohio Water Development Authority.
(d) Nothing contained in this section shall be held to authorize or require the payment of any sewer rental charge by any tax-supported department of the City.
(e) All rates shall be effective on January 1 of each year.

All fees and charges shall be effective on January 1 of each year.

If the whole or any part of the water on which a sewer rental charge is based is shown by an approved measuring device not to have passed into the system of sewerage of the City, then the charge shall be based upon the actual amount of water passing into the City system of sewerage.

The sewer rental charge shall be payable at the same time and place as water bills for the district in which the premises served are located and at the election of the Director of Public Utilities, may be shown as a separate item upon such water bill.

Failure to pay the sewer rental charge by the due date on the delinquent notice sent on unpaid water bills, to which bills were added the sewer rental charges, shall result in shutting off the water service, without regard to change of ownership or occupancy of such premises. Water shall not again be turned on until all sewer rental charges due and payable have been paid.

The Director of Public Utilities shall make and enforce such by-laws and regulations as he may deem necessary for the collection of sewer rental charges and for the safe, economical and efficient management and protection of the sewerage system and sewage pumping treatment and disposal works. Such by-laws and regulations, when published in the City Record as required for ordinances after passage, shall have the same force and effect as ordinances of the City when not repugnant thereto, or to the Constitution or laws of the State.

Moneys received from the collection of the sewer rental charge authorized by this chapter shall be deposited daily with the City Treasurer who shall keep a separate and distinct fund and account to be known as the Sewer Rental Fund. When appropriated by Council such Fund shall be available for the payment of the cost of the management, maintenance, operation and repair of the sewage treatment and disposal works, and any surplus in such fund may be used for the enlargement or replacement of the same and for the payment of interest on any debt incurred for the construction of such sewage treatment and disposal works, and for the creation of a sinking fund for the payment of such debt.
