As used in this chapter:
(a) "Metropolitan area" means the territory within and without the limits of the City of Cleveland to which water is supplied by the Division of Water.
(b) "Zone" means that part of the metropolitan area which, for convenience in reading water meters and rendering water bills, may be so designated by the Director of Public Utilities.
(c) "Low service district" means that part of the metropolitan area which has an elevation above the level of Lake Erie and not exceeding 120 feet above City datum.
(d) "First high service district" means that part of the metropolitan area which has an elevation of more than 120 feet and not more than 250 feet above the City datum.
(e) "Second high service district" means that part of the metropolitan area which has an elevation of more than 250 feet and not more than 500 feet above the City datum.
(f) "Third high service district" means that part of the metropolitan area which has an elevation of more than 500 feet above the City datum.
(g) "Water supply" means water furnished into pipes connected with premises on which the water may be used, but regardless of the amount of water, if any, which may be actually used on the premises. "Water used" means the water taken on the premises from the water supply installed for that purpose, irrespective of the manner in which the water may be disposed of.
(h) "Premises supplied with water" means a lot of land with or without buildings or other structures standing thereon, used as one plant, place of business, residence or other single purpose, to which water has been supplied, ready for use, but shall not include more than one plant or place of business, residence or location used for a single purpose, although the same may be owned, used or controlled by one owner.
(i) "Customer" means any person, partnership, corporation or association to whom or upon whose request water is supplied, including the premises so supplied with water.
(j) "City Water Department" means the Division of Water of the Department of Public Utilities of the City.
(k) "Director" means the Director of Public Utilities.
(l) "Commissioner" means the Commissioner of Water.
As used in division (b) of Sections 535.04, 535.05, and 535.06:
(m) "Homestead" means a dwelling or unit in a multiple-unit dwelling or condominium which has a separate water connection and is owned and occupied as a home by an individual.
(n) "Sixty-five years of age or older" means a person who has attained age sixty-four prior to January 1 of the year of application for the homestead rate.
(o) "Total income" means the adjusted gross income of the owner and the owner's spouse for the year preceding the year in which application for the homestead rate is made, as determined under the "Internal Revenue Code of 1954," 68A Stat. 3, 26 U.S.C. 1, as amended, minus the amount of disability benefits included in adjusted gross income but not to exceed fifty-two hundred dollars, plus old age and survivors benefits received pursuant to the "Social Security Act"; retirement, pension, annuity, or other retirement payments or benefits not included in federal adjusted gross income; tier I and tier II railroad retirement benefits received pursuant to the "Railroad Retirement Act," 50 Stat. 307, 45 U.S.C. 228; and interest on federal, state, and local government obligations. Disability benefits paid by the veterans' administration or a branch of the armed forces of the United States on account of an injury or disability shall not be included in total income. For purposes of computing total income, "old age and survivors benefits received pursuant to the `Social Security Act"' or "tier I railroad retirement benefits received pursuant to the `Railroad Retirement Act"' means:
(1) For those persons receiving the homestead property tax exemption for the first time for tax years 1976 and earlier, the benefits payable under the social security or railroad retirement laws in effect on December 31, 1975, except in those cases where a change in social security or railroad retirement benefits would result in a reduction of income;
(2) For those persons receiving the homestead property tax exemption for the first time for tax years 1977 and thereafter, the benefits payable under the social security or railroad retirement laws in effect on the last day of the calendar year prior to the year for which the homestead exemption is first received, except in those cases where a change in social security or railroad retirement benefits results in a reduction in income.
(p) "Permanently and totally disabled" means a person who has, on January 1 of the year of application for the homestead rate, some impairment in body or mind that makes him or her unfit to work at any substantially remunerative employment which he or she is reasonably able to perform and which will with reasonable probability, continue for an indefinite period of at least twelve months without any present indication of recovery therefrom or has been certified as permanently and totally disabled by a state or federal agency having the function of so classifying a person. An application for reduction based upon a physical disability shall be accompanied by a certificate signed by a physician, and an application based upon a mental disability shall be accompanied by a certificate signed by a physician or psychologist licensed to practice in Ohio, attesting to the fact that the applicant is permanently and totally disabled.
(q) "Owner" includes a vendor in possession under a purchase agreement or a land contract, a mortgagor, one or more joint tenants with rights of survivorship and tenants in common.

For the purpose of assessing charges for water, reading meters and collecting such charges, the metropolitan area so supplied with water shall be divided into zones by the Director of Public Utilities, who shall also fix the dates for reading such water meters and for payment of bills for water so furnished, the amount of which shall be determined in the manner provided in the following sections.

(a) The Director of Public Utilities shall cause water to be furnished free of charge to the Division of Fire for the purpose of extinguishing fire and cleaning fire apparatus. No charge shall be made by the Director for the furnishing of supplying connections with fire hydrants within the territory of the City, nor shall there be a charge for repair and maintenance of fire hydrants. The Director shall cause water to be furnished free of charge to market houses within the territory of the City for the purpose of cleaning market houses, and to public buildings owned by the City for use therein.
(b) In accordance with Charter Section 113, the accounts of the Division of Water shall reflect the value of the services so rendered. If at any time any department or division shall collect for water used from lessees or occupants of all or portions of any public buildings and market houses, such collections shall be at the regular rates for such service and be remitted to the Division. However, in the event only a portion of a building or market house is so used, a prorata charge satisfactory to the Commissioner of Water shall be made.

(b) For Master Meter communities. All bills for water furnished shall be rendered monthly to the municipality or district to which water is so furnished, and if not paid within fifteen (15) days after the date of billing by the City of Cleveland, such bills shall be subject to a penalty of five percent added thereto. In the event that any monthly bill is not paid within four (4) months after written notice is given by the City of Cleveland, the City of Cleveland may, at is option, cease to furnish water to such municipality or district pending payment of any overdue amount.
(c) Rates for Standby Emergency Water Service. The rates to be charged for standby emergency water service shall consist of an annual standby fee of $3600.00 per year in addition to the charge for consumption provided in division (a) of this section. Standby fees for standby emergency water service shall be payable in advance. All bills for water furnished under this section shall be rendered upon the termination of customer's emergency period or, if the duration of the emergency is longer than thirty days, in thirty day intervals. In the event that any standby fee is not paid in advance or any consumption bill is not paid within four months after written notice is given by the City of Cleveland, the City of Cleveland may at its option, cease to furnish standby emergency water service to such customer pending payment of any overdue amount.
(d) Large Industrial Customers. All water used in excess of 62,500,000 cubic feet during a three month billing period shall be charged at a rate of seventy-five percent (75%) of the rate prescribed in this section for water used in excess of one thousand (1,000) cubic feet.
(e) Customers supplied from more than one service district. Customers with premises supplied with water from more than one service district shall be billed at the rate for the service district from which the predominant quantity of water is supplied.

(a) Special Homestead Rate. Homesteads owned by a person sixty-five years of age or older whose total annual income does not exceed the limits listed below or homesteads owned by a person permanently and totally disabled whose total annual income does not exceed the limits listed below may be eligible for the special homestead rate established for the service district in which the homestead is located under Section 535.04 of these Codified Ordinances, provided the owner has obtained approval by their county of residence of a reduction in taxes under the Homestead Exemption provisions of Chapter 323 of the Revised Code. The Director of Public Utilities shall prescribe the application form for the homestead rates and have final approval of all applications.

(b) The Director of Public Utilities may establish an affordability program to provide assistance to eligible low-income customers. The program may offer a reduction of twenty percent (20%) from the water bill for residential customers who have been qualified to receive assistance through the federally funded Home Energy Assistance Program. The Director of Public Utilities shall set the guidelines for administering the affordability program and have final approval of all applications.

(s) The Commissioner may enter into payment arrangements for installment payments of the fees and charges contained in this section or in Section 535.23 when determined to be reasonable by the Commissioner. Failure to make any payment under an arranged payment plan when due shall cause the total unpaid amount to become payable on demand and may lead to termination of water service.

The following conditions shall apply to the furnishing of water to premises outside of the territorial limits of Cuyahoga County upon a direct service basis:
(a) No water shall be furnished to any premises not connected to the sewerage system of the municipality in which such premises is located, or, if no such municipal sewerage system is available, such premises shall have available a method of sewage disposal approved by the State.
(b) No water main shall be laid or extended except upon approval first obtained from the Division of Water of the City of Cleveland.
(c) Meters shall be installed and paid for by the owner or person applying for water service to such premises, and shall be assigned to the Division for future maintenance and repair.
(d) All meters shall be read and billing made for water consumed once in each three-month period.
(e) The furnishing of water shall at all times be subject to the ordinances of the City.
(f) The Director of Public Utilities shall make such further conditions of furnishing water to such premises as are not in conflict with this section or these Codified Ordinances.

The Director of Public Utilities may enter into direct-service and master-meter water service agreements with municipal corporations or public authorities for water service under rates, terms, and conditions that differ from those contained in Chapter 535 for the purpose of meeting competition from alternative water suppliers if all of the following apply:
(a) The municipal corporation or public authority has access to an alternative water supplier or is likely to gain such access in the reasonably foreseeable future;
(b) The revenue to be generated under the contract is not below the cost of service, as determined by the Division of Water;
(c) The contract is for a term of at least twenty years;
(d) The contract, with the exception of negotiated provisions, is substantially in the form of the Division of Water's standard direct-service and master-meter agreements;
(e) The contract has been approved by the Director of Law; and
(f) The contract has been approved by the City Council upon a finding that entering into the contract is necessary to meet competition from current or potential alternative suppliers and is in the best interests of the Division of Water and its water customers and bondholders.

The Director of Public Utilities shall assess and collect proper charges for water, materials supplied and work done.

(a) Water bills shall be payable at intervals of three or six months, as determined by the Director of Public Utilities.
(b) In rendering six-month bills, the number of days and the consumption shall be divided into two equal parts and each part computed according to the rate schedule as set forth in this chapter.

Water bills shall be paid on or before the date stated on the bill but the Director of Public Utilities may, after investigation, grant an extension of time for payment not to exceed ninety days in cases of indigency, emergency, relief and similar conditions. Partial payments may be accepted, properly approved, but bills must be paid in full before the expiration of the ninety-day period.

Charges for work done or materials furnished by the Division of Water shall be chargeable against the owners of the premises served as in the case of charges for water. Charges for work done or materials furnished, contract bills on main extensions, improvement charges, main pipe extension charges, meter repairs and final water bills, shall be payable forthwith.

Where the account is unpaid by the due date, the Director of Public Utilities may cause a notice of delinquency to be mailed to the account holder. Tenants of a residential premises who have received the notice provided for in Section 535.16 may maintain service to the premises if:
(a) Any or all of the tenants, through a representative acting on behalf of all the tenants, pay a deposit on the account as determined by Section 535.15, and assume responsibility for paying future bills as they become due, or
(b) At least fifty percent (50%) of the tenants:
(1) Deposit the rent when it becomes due with the Clerk of the Municipal Court having jurisdiction over the premises, as provided in RC 5321.07(b)(1), and
(2) Apply to the Court for an order to use the rent deposited to pay the account delinquency as provided in RC 5321.07(b)(2); and
(3) Continue to deposit rent as it becomes due until such time as the account delinquency is removed.
If service to a tenant-occupied residential premises has been terminated pursuant to Section 535.16, such service shall be restored and maintained for such time as the tenants comply with the above procedures. The Director of Public Utilities shall establish such rules and regulations as are necessary to implement this section.

(a) Applications for the use of water shall be made and accepted in a manner prescribed by the Director of Public Utilities. All accounts for water service shall be established and maintained in the name of the record title owner of the premises served thereby. Any owner of real estate premises to which water is supplied shall be deemed primarily liable for all water and service charges for such premises, whether or not the premises is occupied by the owner, tenant or other persons, and whether or not the account has been established in the name of some other person or entity. In addition, any user and/or occupant of the premises where water service is provided shall be liable for payment for such services.
(b) The Director of Public Utilities may require a deposit to be placed on an account whenever the account holder:
(1) Does not have an established credit history with the Division of Water.
(2) Has received delinquency or termination of service notices and wishes to avoid such termination.
(3) Has had service terminated for nonpayment.
(4) Is a debtor in a pending case in U.S. Bankruptcy Court.
(5) Refuses to allow employees of the Division of Water to enter upon the premises served for the purposes of meter reading, repairs and/or testing.
The deposit amount shall equal two average quarterly bills on that account which shall be calculated based on the previous twelve (12) months' consumption at the premises served.
(c) Deposits held by the Division of Water shall not be applied to current water or sewer bills. However, a deposit held on an account shall be returned to the depositor if, subsequent to the date of the deposit, four consecutive bills are timely paid. If a deposit is held on an account at the time it is closed, the deposit shall be applied to any final amount outstanding, and the balance, if any, shall be returned to the depositor.

Water service may be terminated at any premises where any water bill remains unpaid after the date payment is due, subject to the following:
(a) The Division of Water shall send to the account holder a notice of termination of service at least fifteen days prior to such termination.
(b) Where the Division of Water has reason to believe that the premises where service is to be terminated is occupied by residential tenants, the Division shall provide at least thirty (30) days' notice to any such tenants by mail or by posting a notice of termination on all accessible building entrances and, where possible, at the door of each dwelling unit. The notice shall inform the tenants of the remedies available to them under Section 535.14 of this Chapter.
Except as provided in Section 535.14, water service at a premises terminated for nonpayment shall not be restored until all charges due and payable have been paid, whether or not there has been in the meantime a change of ownership or possession of the premises supplied.

(a) Whenever any premises have their own water supply but in addition service connections extend from the mains in the street into such premises for use only in case of failure or insufficiency of their own supply, the same minimum semi-annual payments shall be made for such service connections as are established by Sections 535.04 and 535.05.
(b) Such payments shall be required whether the connection is on or off and shall cease to be required only when and if the connection with the City's main has been cut and plugged.

A charge shall be made for each unmetered fire supply connection within the limits of the City and direct service suburbs. The charge shall be determined by the size of the fire supply connection through which water passes for use on the premises so supplied under Section 535.06 of the Codified Ordinances for each three months or any part of three months.
Charges shall be collected quarterly for each fire supply connection to cover inspection, testing, sealing and resealing of such service connections, stand-by pumpage capacity, and replacement or cleaning of distribution or trunk water mains to improve the water supply for fire protection purposes.

The Director of Public Utilities is authorized to provide for the disinfection of water mains by chlorination or flushing, including sampling. The charges associated with the work shall be under Section 535.06 of the Codified Ordinances.

Whenever the Division of Water installs a water main less than twenty inches (20″) in diameter within the corporate limits of a municipal customer, and the main is designated to be a restricted main, the Division of Water shall have the right to restrict the use of the main so that it would not be permitted to be tapped for service connections or connecting water mains. The Division of Water shall have the right to allow service connections to be tapped to the main, and shall have the right to condition the permission on the payment of a tap-in charge representing a fair portion of the Division of Water's cost of installation of the main.

(a) In addition to other charges, if water is used from a public fire hydrant, a private fire line system, or any other unmetered source, upon special permit only, a charge for the permit and a hydrant rental, if applicable, must be paid in advance under Section 535.06 of the Codified Ordinances. A separate permit shall be issued for each hydrant which shall identify its location.
(b) Water may be furnished from a fire hydrant, a private fire line system, or any other unmetered source, for any special purpose authorized by the Commissioner of the Division of Water. The charge for water so furnished shall be under Section 535.04 for the service district in which the fire hydrant private fire line system, or other unmetered source is located, but shall not include a discounted rate for the first 1,000 cubic feet of water. The quantity of water used may be estimated by the Commissioner based on information provided by the user as to the user's purpose and needs, or the Commissioner may require the installation of a meter at the connection to the hydrant to be used, in which event the user shall pay the cost of installing the meter and the cost of all water measured.

All water for building or construction purposes, whether public or private, shall be paid for under Sections 535.04 and 535.06 of the Codified Ordinances. In the case of water to be used for building purposes, the Director of Building and Housing, before granting any permit to erect, repair, change or alter any building or structure, shall first require the owner of the building to pay in advance an amount as is justly chargeable for water to be used in erecting, repairing, changing or altering such building or structure, and on the refusal of the owner to pay the charges in advance, the Director shall refuse to grant the permit. Charges shall be based on estimates of the amount of masonry, walls, plastering and other work for which water is used in construction, computed according to the accepted rules of the Division of Water. If desired by the property owner or contractor, water for building or construction purposes may be taken through a meter, furnished and set at the expense of the owner or contractor, and paid for at the rate set forth in Sections 535.04 and 535.06 of the Codified Ordinances. However, the advance payment for water in any case shall be made, as previously stated, and if the supply of water is taken entirely through a meter, the charge shall be adjusted under the amount registered by the meter, and the excess of the advance payment, if any, shall be refunded on the completion of the work.

For purposes not named in the foregoing sections, or for the use of water under special circumstances, special rates shall be made by the Commissioner of Water.

(a) No person shall use any hydrant for construction or other purposes without first obtaining a permit for such use from the Commissioner of Water. Such permit shall be charged under Section 535.06 of the Codified Ordinances.
(b) All hydrants used for any construction purpose, such as sewers, buildings, paving, etc., must have reducing couplings attached to the nozzles of the hydrants, with an independent valve for regulating the supply.
(c) The main valve of the hydrant must be opened full at the beginning of work each day, and remain open until the stoppage of work at night. The water supply shall be regulated by the independent valve. The hydrant shall be operated only by a proper hydrant key, which shall be obtained from the Division of Water.
(d) Water must not be allowed to run except when used. No leaking hose, pipe or joints shall be permitted. All persons using hydrants shall immediately obey any instructions or orders that may be issued by the Commissioner of Water, or his authorized agents, to regulate the use of these hydrants.
(e) In case of failure to comply with the requirements of the Division, the water supply shall be stopped immediately, the hydrant permit revoked and no new permits for the use of any hydrant shall be issued until all damages or charges for the waste of water have been paid.
(f) If required by the Commissioner, a meter shall be applied to the connection made with the hydrant, at the expense of the party using the same and the party shall pay for all water by meter measure.

Each direct service municipality shall pay an annual fee, in advance, for the use of water from fire hydrants located in the municipality, for a purpose other than the extinguishment of a fire. The annual fee per hydrant shall be calculated as of January 1 of each year by multiplying one-half mcf (500 cf) by the highest rate then authorized to be charged to a direct service customer located in the service district in which such hydrant is located.
A certified statement of the number of fire hydrants located in each service district in the municipality on January 1 of each year shall be submitted to the Commissioner of the Division of Water by an officer of each municipality on or before January 10 of each year. The total annual fee shall be paid by each direct service municipality on or before January 20 of each year.

The Commissioner of Water may make such abatement as seems to him right and proper in the case of a leak, where it does not appear that the owner or user could be reasonably expected to know of the leak and to have had a fair chance to repair the same. Such reduction shall not exceed one-half of the excess bill, except as otherwise determined by the Commissioner with the approval of the Director of Law.
The authority hereby vested in the Commissioner to make abatements shall be without prejudice to and not in derogation of the power and authority of the Director of Law conferred by Section 125.03.

(a) All charges for water shall be made against the premises supplied or against the customer contracting for the service.
(b) Upon special request, made by a customer accompanied by a list of premises owned by him, bills for water rent of all such premises shall be sent or delivered to such customer.
(c) However, the amounts of water used by separate premises shall not be pooled or combined into one charge, but separate charges shall be computed for separate premises.

If the meter fails to register correctly, the customer shall be charged for water at the average daily rate of consumption estimated by the Commissioner of Water, as based upon use under similar conditions when the meter is in good order. The Commissioner may establish reasonable limitations within which a meter shall be deemed to register correctly.

On premises where the supply of water is through a meter, and where the water is turned off by the Division of Water, at the request of the customer, a charge equal to one-half the semi-annual minimum shall be made semi-annually for such time the water remains turned off.

Every person desiring a supply of water from the mains in the metropolitan area must make application at the office of the Division of Water for a service pipe and connection with such mains; except that arrangements may be made for applicants outside of the City to make application for service connections at the office of their respective municipalities, provided an agreement to this effect has been entered into between the Division and such municipality.

(a) Distribution mains shall be not less than eight inches and no more than sixteen inches in nominal diameter.
(b) The distribution water mains shall be laid out in a properly segmented grid system, so that the interruption of service to consumers is kept to a minimum in case of breaks or repairs.
(c) The Commissioner of Water shall determine the size of and materials used for all water mains with the following minimums as to sizes for new improvements or replacement of existing distribution water mains:
(1) Streets within residential areas, eight inches size, provided such streets do not exceed 1,500 feet in length between intersecting streets improved with water mains.
(2) In county roads, crossings under freeways and railroads, crossing in bridges and in streets adjoining commercial or industrial developments, twelve inches in size.
(3) In streets extending through several municipalities and designated as State or county streets, roads or highways, sixteen inches in size.

(a) No water mains shall be laid or extended within the City or in any direct service suburb unless properly submitted plans have been approved by the Commissioner of Water as being in accordance with the Department of Public Utilities construction and material specifications.
(b) After installation no water main laid in the City or in any direct service suburb shall be placed into service carrying potable water unless the installation has been approved by the Commissioner as meeting the Department of Public Utilities Construction and Material Specifications, and samples of water taken from the new main installation have passed bacteriological testing as required by the Ohio Environmental Protection Agency.
(c) Authority to approve water mains in subsections (a) and (b) hereof and as outlined in service agreements with master meter suburbs shall be vested solely in the Commissioner.

Fire hydrants shall be placed on all new distribution water main improvements or replacements of existing distribution water mains and shall be of six-inch size having a six-inch nominal diameter of the main valve opening. Each hydrant shall be connected to the water main with a six-inch branch with gate valve installed on each hydrant branch approximately three feet from the water main, and of the same size as hydrant. Fire hydrants shall be placed at street intersections wherever spacing will permit. Fire hydrants in residential streets are to be installed at the center of sublots and spaced on an average of 300 feet apart. In commercial and industrial areas, hydrants shall have an average spacing of 250 feet apart, with a maximum distance of 280 feet apart.

(a) No person shall take water or in any way use water for private use which is furnished by the Division of Water, unless pursuant to the applicable sections of this chapter, such person first pays for the same and receives the usual permit from the Commissioner of Water to do so, except for the extinguishment of fires.
(b) Whoever violates the provisions of this section shall be fined $150.00. A separate offense shall be deemed committed each day during or on which a violation continues or occurs.

No person shall permit water to run when not in actual use, and the owner or occupant of the premises must prevent all waste of water.
No person, when the service is not metered, shall sprinkle any lot, street or sidewalk, between the hours of 8:00 a.m. and 5:00 p.m., nor more than five hours in any day.
Yard fountains, when the service is not metered, shall not be used longer than three hours per day during the summer season, unless especially permitted and on additional payment. The right is reserved to suspend their use whenever the public exigency may require it.
No person, agent, firm or corporation shall sell by deed, land contract or otherwise any interest in any premises within the metropolitan area as defined in Section 535.01 (a) which is supplied with City water without furnishing the buyer prior to such sale, a statement from the Division of Water setting forth the current status of the water account of the premises, and when an escrow has been established, depositing in escrow prior to delivery of possession or transfer of title a statement from the buyer acknowledging the receipt of this document and accepting responsibility for all future water bills in accordance with these Codified Ordinances.

No person, firm or corporation acting in the capacity of an escrow agent in any real estate transaction involving the sale of any premises situated in the metropolitan area as defined in Section 535.01 (a) which is supplied with City water shall disburse any funds unless the provisions of Section 535.41 have been met.

Conviction under this section shall not be a bar to the rights of a buyer to recover by civil suit from either the previous owner (seller), real estate agent or escrow agent the amounts for water supplied to the previous owner and paid by the buyer under the provisions of Section 535.44.

When the Director of Public Utilities determines that a shortage of water supply exists which threatens the public health and safety and that the shortage makes it necessary to curtail water use within all or any part of the City the Director shall proclaim a water use emergency throughout all or any part of the City.
A water use emergency proclamation shall specify:
(a) the geographic area affected by the water use emergency;
(b) the length of time the emergency shall be in effect, which time shall not exceed seven (7) days; and
(c) the degree of water use curtailment.
During a water use emergency, the Director may order water use curtailment by prohibiting unnecessary use or consumption of water during all or specified hours of the day and/or may order that specified premises curtail necessary use or consumption of water on specified days only as the Director shall determine to be necessary.
A proclamation of a water use emergency shall become effective at the time of issuance by the Director. Notice thereof shall be given to a newspaper of general circulation in the City and shall be reported to a local radio and television station for broadcast.
As used in this section, unnecessary use or consumption means the use or consumption of water for purposes other than personal health, safety, sanitation and bodily consumption. "Unnecessary use or consumption" of water includes but is not limited to sprinkling or watering lawns, other land irrigation, the washing of automobiles, houses or other structures and the use of water for recreational purposes such as the maintenance of swimming pools. The use of water for private construction such as the mixing and curing of concrete, the puddling of backfill in excavations, the moistening of masonry walls preparatory to pointing or sealing, and other similar uses is not an unnecessary use or consumption of water. The use of water to scrub and rinse areas such as hard-surfaced drives, garage floors, patios and similar uses where necessary for the purpose of sanitation and the protection of health is not an unnecessary use or consumption of water.
No person or entity shall during a water use emergency use water in violation of the terms and conditions of the Director's water use emergency proclamation.
Whoever violates this section is guilty of a minor misdemeanor. Whoever violates this section having been previously convicted of a violation of this section is guilty of a misdemeanor of the third degree. A separate offense shall be deemed committed each day during or on which a violation or noncompliance occurs or continues.

The Division of Water shall charge an account holder under Section 535.06 of the Codified Ordinances for any check returned for lack of sufficient funds.

Any person, firm or corporation including escrow agents, violating the provisions of Sections 535.41 and 535.42, shall be fined not less than fifty dollars ($50.00) nor more than five hundred dollars ($500.00).
