363.001 Definitions Generally
As used in this Housing Code, certain words and terms are defined as provided in this chapter.

363.01 Approved
"Approved" means approved by the Commissioner of Housing as authorized in this Code, or by the Board of Building Standards and Building Appeals, or approved by any other authority designated by these Codified Ordinances to give approval to the matter in question.

363.02 Commissioner of Housing
"Commissioner of Housing" shall be construed as though followed by the words "or his authorized agent or representative."

363.03 Communal Kitchen
"Communal kitchen" means a kitchen within a dwelling building used by the occupants of more than one dwelling unit or shared by any persons residing in a rooming occupancy.

363.04 Dwelling Building or Structure
"Dwelling building or structure" means a building or structure used or designed or intended to be used, all or in part, for residential purposes.

363.05 Dwelling Unit
"Dwelling unit" means a room or group of rooms located within a dwelling structure and forming a single habitable unit with living, sleeping, cooking, eating and sanitary facilities used or intended to be used by one family.

363.06 Family
"Family" means one or more persons related by blood, adoption or marriage, or a family foster home, living and cooking together as a single housekeeping unit, exclusive of house-hold servants. A number of persons, but not exceeding three living and cooking together as a single housekeeping unit though not related by blood, adoption or marriage shall be deemed to constitute a family. A family foster home shall mean a family related by blood, adoption or marriage as defined above with no more than five foster children.

363.07 Habitable Room
"Habitable room" means a room or enclosed floor space used or intended to be used for living, sleeping or eating purposes, excluding kitchens (except where eating space is included in a room also used for cooking), bathrooms, toilet rooms, laundries, pantries, dressing rooms, storage spaces, foyers, hallways, utility rooms, heater rooms, boiler rooms and basement or cellar recreation rooms.

363.08 Hotel
"Hotel" means a building or part thereof in which rooms are available for hire as lodging to the general public, which rooms are occupied as a rule transiently and singly, rather than as dwelling units, and in which building food and drink may be served for consumption by the general public, and shall include all buildings known as motels or motor hotels, which conform to this definition.

363.09 Multiple Dwelling
"Multiple dwelling" means a dwelling structure occupied for residence purposes by more than two families, or by individuals living in a rooming occupancy as defined herein, or by both.

363.10 Occupant
"Occupant" means a person over one year of age, living, sleeping, cooking or eating in, or having actual possession of, a dwelling unit or a room used for rooming occupancy.

363.11 Operator
"Operator" means a person who has charge, care, management or control, whether as owner, manager, executor, administrator, trustee, guardian, receiver or otherwise, of a building, dwelling, structure or part thereof in which dwelling units or rooming occupancies are let in or used for purposes of use as described in these Codified Ordinances.

363.12 Owner
"Owner" means the owner or owners of the premises, including the holder of title thereto subject to contract of purchase, a vendee in possession, a mortgagee or receiver in possession, a lessee or joint lessees of the whole thereof or an agent or any other person, firm or corporation directly in control of the premises.

363.13 Premises
"Premises" means a lot, parcel or plot of land including the buildings or structures thereon.

363.14 Rooming Occupancy
"Rooming occupancy" means that use wherein a room or group of rooms in a dwelling structure is used or intended to be used for living or sleeping but not for cooking or eating purposes. However, where one or two roomers are accommodated within a dwelling unit occupied by a family, or where a dwelling structure is occupied by not more than two families and not more than two roomers or boarders per family, the accommodations so provided shall not be deemed to be a rooming occupancy.

363.15 Secondary or Appurtenant Structure
"Secondary or appurtenant structure" means a structure, the use of which is incidental to that of the main building, and which is attached thereto or located on the same premises.

363.16 Supplied
"Supplied" means paid for, furnished or provided by, or under the control of the owner or operator.

363.17 Row House
"Row House" means an attached house in a row or group, each house containing not more than two dwelling units and each house separated from adjoining houses in the same row or group by fire walls or separators.

363.18 Basement
"Basement" means that portion of the building located partly under ground and conforming to Sections 369.01 and 369.02 and other provisions of these Codified Ordinances.

363.19 Cellar
"Cellar" means that portion of the building located partly under ground and does not conform to Sections 369.01 and 369.02 and other provisions of these Codified Ordinances.

363.20 Garbage
"Garbage" means the animal, vegetable or mineral waste from the handling, preparation, cooking and consumption of food.

363.21 Rubbish
"Rubbish" means combustible and noncombustible waste materials, except garbage; and includes the residue from the burning of wood, coal, coke and other combustible material, paper, rags, cartons, boxes, wood excelsior, rubber, leather, tree branches, yard trimmings, tin cans, metals, mineral matter, glass crockery and dust.

363.22 Infestation
"Infestation" means the presence, within or around a dwelling, building or structure, of any insects, rodents or other pests.

363.23 Plumbing
"Plumbing" means and includes all of the following supplied facilities and equipment: water pipes, gas lines, garbage disposal units, waste pipes, water closets, sinks, installed dishwashers, lavatories, bathtubs, shower baths, installed clotheswashing machines, catch basins, drains, vents and any other similar supplied fixtures, together with all connections to water and sewer lines.

363.24 Kitchen
"Kitchen" means a room or area used or intended to be used or containing the facilities for cooking or the preparation of meals.

363.25 Kitchen Sink
"Kitchen sink" means a sink of a size and design adequate for the purpose of washing eating and drinking utensils, located in a kitchen and properly connected with both hot and cold water lines as required.

363.26 Lavatory
"Lavatory" means a hand washing basin which is properly connected with both hot and cold water lines and which is separate and distinct from a kitchen sink, as required.

363.27 Nondwelling Structure
"Nondwelling structure" means any structure except a dwelling used or intended to be used for the shelter or enclosure of any person, animal or property of any kind.

363.28 Yard
"Yard" means all ground, lawn, court, walk, driveway or other open space constituting part of the same premises of a dwelling, building or structure.

363.29 Condemned
"Condemned" means a structure or part thereof that has been determined by the Commissioner of Housing as unfit for human habitation.
