309.01     Platting Rules Adopted; Subdivision Defined

(a) The following rules and regulations relative to the platting of land and the dedication of new streets to be shown on such plats heretofore approved by the Platting Commissioner and the Planning Commission are hereby adopted and promulgated.

(b) "Allotment" or "subdivision" are used in this chapter synonymously and refer to any subdivision of land into either streets and lots or into lots, and intended to be recorded as a plat.

309.02     Plat Drawing Requirements

The plat of a proposed subdivision shall be drawn in ink upon good quality tracing cloth. It shall ordinarily be drawn to either the scale of one inch equals 100 feet, or one inch equals fifty feet. All dimensions shall be shown in feet and decimals of a foot. The plat shall be complete and consistent in itself as to all measurements. The streets shown on the plat shall be named as required by Chapter 305.

309.03     Terminals and Monuments

The plat shall show the location of the terminals of existing streets in adjoining property, with such dimensions as are necessary to show their relation to streets which are being dedicated by the plat. The plat shall show the location of monuments placed on the ground to define street lines.

309.04     Surveyor's Statement

The plat shall contain a statement from the surveyor preparing the same, definitely identifying the land proposed to be dedicated to the public, as provided by law.

309.05     Filing and Drawing Street Profiles

Profiles of the streets to be dedicated, showing existing surface elevation and proposed grades of such streets, shall be filed with the Commissioner of Engineering and Construction. Profiles shall be made upon cross section tracing cloth to the scale of one inch horizontal equals 100 feet and one inch vertical equals ten feet. When required by the Platting Commissioner a topographical map of the territory to be allotted shall be furnished in addition to the street profiles.

309.06     Certificate of Title to Dedicated Lands

An abstract or certificate of title, meeting the approval of the Director of Law, of the lands to be dedicated, shall be furnished to the City to become its property.

309.07     Reserve Strips

No plat or map of a proposed street or allotment showing reserve strips controlling access to public ways, or showing strips of land which will not prove taxable for special improvements, will be approved. However, such reserve strips may be shown when the control and disposal of land comprising such strips are definitely placed with the City under conditions meeting the approval of the Platting Commissioner and the Director of Law.

309.08     Street Locations and Widths

The location and widths of proposed streets shall be such as to fit in with any plan of street development adopted by the Planning Commission. Due regard shall be given to existing streets or streets capable of being established in surrounding property so that streets may be laid out through adjacent or neighboring allotments with reasonable continuity of location and width.

309.09     Minimum Street Widths; Use of Alleys

The minimum width of any proposed street shall be fifty feet between property lines, provided that in the subdivision of the property a minimum depth of lots of 100 feet can be obtained. In narrow parcels alongside of developed property, or where less width would be required in order to secure lots 100 feet in depth, a narrower street may be permitted upon the approval of the Planning Commission. Alleys, meaning streets less than twenty feet in width, may be laid out in the rear of lots fronting on an adjoining street when such lots do not exceed 150 feet in depth. At the intersection of streets the rounding of corners may be required.

309.10     Use of Intersecting Streets

Where practical, an intersecting street shall be provided, so that no block will be longer than 1,000 feet.

309.11     Continuation of Existing Streets in New Allotments

In order that proposed streets may be so nearly coterminus as possible with existing streets in adjoining allotments, due provision shall be made for the direct continuation of all existing streets which extend to the boundaries of a proposed allotment. In case of adjacent allotments, separated by existing thoroughfares, due provisions shall be made for continuing, in a practical manner, such of the existing streets through the proposed allotment as may be necessary for public requirements, subject to the approval of Council, and provided that in cases where there is a departure from the direct continuation of such streets, Council shall be advised thereof in writing by the Platting Commissioner, prior to the approval of the plat by Council.

309.12     Increased Street-Width Requirements

The Platting Commissioner may require wider streets than fifty feet, whenever in his judgment, provisions for public travel make the wider street desirable, or wherever any general plan of street development adopted by the Planning Commission requires the establishment of streets of greater width. In general, streets of not less than 100 feet wide may be required at intervals not greater than 6,000 feet, and streets not less than eighty feet wide, at intervals not greater than 3,000 feet.

309.13     Use of Dead-End Streets

No so called dead-ended streets will be approved for dedication except where physical conditions make the extension of such a street impractical. In such cases a dead-end street may be approved, provided that adequate turning space for vehicles is placed at the dead-end.

Turning spaces shall be of sufficient size to provide for a paved circular space of at least sixty feet in diameter, or of a rectangular space twenty-five feet wide and eighty feet long, having its eighty-foot dimension placed symmetrically perpendicular to the line of the street, both of such spaces being exclusive of any sidewalk space.

309.14     Street Extensions to Unallotted Property

Where the land for a proposed allotment adjoins unallotted property capable of being allotted, then the streets in such proposed allotment need only be carried to the boundaries thereof.

309.15     Acquiring Property for Streets Outside Allotment

Where, in order to comply with the requirements of the Planning Commission, it is necessary to acquire property for a street outside of the boundaries of the land to be alloted, the land required for the street may be acquired by the City, but the expense thereof shall be borne by the owners of the allotment.

309.16     Grade Requirements; Monuments

(a) Before approval will be given upon any plat dedicating streets to public use, except as hereinafter provided, the streets shall have been graded to a grade approved by the Commissioner of Engineering and Construction, and sidewalks shall have been constructed of stone or cement in accordance with the City's specifications, to a width meeting the approval of the Commissioner.

(b) Stone monuments, provided with drill holes, to indicate all street lines, shall be placed at street intersections, at points of change of alignment and at ends of streets, should the same not be at a street intersection. The monuments shall be of suitable hard stone free from ingredients likely to cause disintegration and shall be at least twenty inches in depth, five inches wide and five inches long. The monuments shall be set so that their tops will be approximately ten inches below the established grade of the street.

309.17     Allotment Owner Responsible for Culverts, Bridges, Repaving, Etc.

All culverts or bridges necessary within the limits of the streets to be dedicated, all box culverts and drainage outlets necessary to carry surface drainage and all of the work necessary in the intersections of the proposed streets, with existing street, including the repaving of such intersections and providing catch basins at such locations, shall be done by the owner of the proposed allotment, or land proposed for dedication, and all to the approval and satisfaction of the Commissioner of Engineering and Construction.

309.18     Special Improvements for Streets

Special improvements such as sewer, water and paving, may be provided by those dedicating the proposed streets, provided that such work is done in accordance with the City's standard specifications and ordinances governing such work.

309.19     Water Connections in Sewerless Districts

Whenever, in any part of the City, there are no sewer facilities available, no water connections will be made by the Division of Water to any property in any such sewerless district, unless the Commissioner of Water has first received the assurance in writing from the Commissioner of Engineering and Construction, that the providing of sewerage is within reasonable prospect. In the absence of such assurance, the Commissioner of Health may in special cases, approve such water connections where the health and welfare of the public will not be jeopardized by such action.

309.20     Water and Sewerage Facilities Required for Plat Approval

No plat of a proposed street or allotment will be entitled to the approval of the Platting Commissioner unless it is possible to supply proper water and sewage facilities thereon as a part of the existing or proposed water and sewerage systems of the City.

309.21     Bond for Plat Approval

Should it not be desirable or possible to do all of the work herein required to place proposed streets in acceptable condition prior to the submission of the plat to Council for approval, provided that a suitable bond from an approved surety company, acceptable to the Director of Law, is given to the City, under the terms of which bond the completion of the work shall be assured within the time fixed by such bond.

309.22     Disposition of Approved Plat

Any map or plat laying out streets or lots, when approved by the Platting Commissioner, shall have such approval endorsed thereon, whereupon the map or plat, after the approval by Council has been noted thereon, shall be retained by the City until it is delivered to the County Recorder for record. All fees required in connection with the recording of the map or plat shall be paid by the property owners causing same to be made.

309.23     Acceptance of Streets

After the map or plat referred to in this chapter has been recorded and the required improvements in a street are made, an ordinance accepting such a street as a public thoroughfare may be passed by Council.

309.24     Territorial Jurisdiction

Sections 309.02 to 309.05, 309.08 to 309.14 and 309.22 shall apply to the approval of plats or maps of land lying outside of, but within three miles of the limits of the City of Cleveland, over which the Planning Commission or the Platting Commissioner has platting control, except that the plat of land not within the City need not be submitted to Council and shall be delivered by the City to the County Surveyor after approval.

309.25     Reserved

309.26     Approval of Nonconforming Lots

In the case of an application to subdivide and/or consolidate land so as to create a lot or lots which do not meet minimum lot area or lot width requirements as established in the Zoning Code, the City Planning Commission may approve such an application if it determines that the resulting lots will be similar in area and width to lots which are common in the immediate vicinity and further determines that such lots can be developed in a manner which will not be detrimental to the public health, safety and welfare.

309.28     Fee for Plan Review for Lot Splits and Lot Consolidations

Each application to the Platting Commissioner to begin the process for a lot split or a lot consolidation shall be accompanied by a nonrefundable fee of one hundred dollars ($100.00) per plat.
