There is hereby established a Boxing and Wrestling Commission to consist of three members to be appointed by the Mayor in accordance with Charter Section 70, and to serve at the pleasure of the Mayor. The Mayor shall also appoint a secretary to the Commission.

Consistent with the provisions of RC 3773.31 to 3773.58 and the administrative rules of the State Boxing Commission now or hereafter adopted, as incorporated by reference in this chapter, with respect to boxing exhibitions, and consistent with the provisions of this chapter and the rules of the Cleveland Boxing and Wrestling Commission, with respect to wrestling exhibitions:
(a) Application for boxing and wrestling exhibitions shall be made to the Boxing and Wrestling Commission. The Commission shall make or cause to be made thorough investigations of all such applications to determine the financial responsibility and the general character of the applicants, the fitness of the prospective participants in the boxing or wrestling exhibitions proposed and such other matters as may be pertinent to the granting of the application. Each application for a wrestling exhibition shall be accompanied by a cash bond, certified check, bank draft or surety bond of not less than five thousand dollars ($5,000).
(b) The Commission shall report the results of its examinations to the Mayor with a recommendation as to whether each such application should be granted or not.
(c) The Mayor may grant such permits in accordance with State law and the rules and regulations of the Commission. No boxing or wrestling exhibition shall be held within the City unless authorized by such a permit, excepting only that this requirement shall not apply in the case of wrestling exhibitions given in theaters as a regular part of the theater program.

Consistent with RC 3773.31 to 3773.58 and the administrative rules of the State Boxing Commission adopted by Section 165.04, the Boxing and Wrestling Commission shall make, and may amend, alter or repeal, such additional rules no less stringent than those of such RC sections, and administrative rules as it may deem necessary in the public interest to regulate and control the conditions and conduct of boxing and wrestling exhibitions. The Commission may suspend and/or fine a promoter, manager, boxer or wrestler pursuant to its rules. The Commission shall enforce and see to the enforcement of its rules.

RC 3773.31 to 3773.58 and such administrative rules as the State Boxing Commission may now or hereafter adopt, amend or rescind are hereby incorporated by reference in this chapter. The Boxing and Wrestling Commission is hereby authorized to exercise those powers, duties and functions granted to the State Boxing Commission by such RC sections and rules, and to levy and collect for payment into the General Fund account established for the Boxing and Wrestling Commission to the benefit of the Commission and the City, those fees, charges and taxes imposed or allowed by this chapter or other fees, charges and taxes which may be imposed or allowed by the City.

(a) Consistent with RC 3773.54, a person issued a permit to conduct a boxing match or exhibition shall pay to the City treasurer a tax of five percent of the gross proceeds from the sale of tickets to the match or exhibition.
(b) A grantee of a permit for a professional wrestling exhibition shall pay to the Treasurer a fee equal to five percent of the gross receipts of the wrestling exhibition held under such permit, excluding any tax which may be imposed under Federal or State law. However, no fee shall be required in the case of a wrestling exhibition given by a charitable organization or church.

There is hereby established within the General Fund a special account to be known as "126-Boxing and Wrestling Commission."

No expenditure shall be made for the purposes of the Boxing and Wrestling Commission in excess of the revenues received in any year from the fee imposed upon the holding of boxing and wrestling exhibitions in the City, pursuant to Section 165.04, except by the transfer of an appropriation pursuant to Charter Section 41.
