Pursuant to Charter Section 76-7, there is hereby established a Port and Harbor Commission to consist of nine members to be Appointed by the Mayor in accordance with Charter Section 70, to serve without compensation and at the pleasure of the Mayor. The Mayor shall designate one of the members to serve as Chairman and shall appoint a secretary for the Commission, who may be selected from the members of the Commission or who may be an officer or employee of the City, who shall serve in that capacity without additional compensation.

The Port and Harbor Commission shall make its own rules and regulations and shall keep a journal of its proceedings. The Commission is authorized to call upon the various officers and employees of the several departments of the City for such information and assistance which it may need in the carrying forward of its work. The Commission, with the approval of the Mayor, shall have power to employ other experts and assistants, provided Council has first appropriated funds for that purpose.

(a) The Port and Harbor Commission may employ one or more of its members who, by reason of scientific or professional knowledge, may be especially qualified for the purpose, to do such engineering, landscaping, architectural and other professional work as may be authorized by such Commission, and when any member of the Commission has been so designated, the Board of Control shall then fix the compensation of such member of the Commission performing such special work.
(b) Whenever the City requires special engineering, legal, landscaping, architectural or other professional service, which the regular officers and employees of the City for any reason are not able to render, and a member of the Commission is particularly qualified to render such service, the Mayor, with the approval of the Board, may contract therefore with such member, and the latter may receive such compensation from the City as is provided in such contract. Such compensation shall be payable from the appropriation of the departments requiring such special services or from bonds issued for the improvement in connection with which such services are required.

The Port and Harbor Commission shall make a comprehensive study of the plan and program for the development of the waterfront of the City and vicinity, and include in such study all the waterfront extending from and including Rocky River on the west, to and including Chagrin River on the east. The Commission shall reduce its finding and recommendations to writing and submit the same to the Mayor and shall accompany the same with an estimated budget of expenses necessary to be incurred in the development of such port and in the further work of the Commission. The Commission, with a view to exercising and conserving the rights conferred upon the City under RC 721.04, shall also have the power and duty to adopt rules and regulations, consistent with the provisions of RC 721.04, governing the erecting and placing of any building or structure of any kind or nature proposed to be erected or placed within the City between E. 9th and E. 72nd Street upon any land situated northerly of a line 300 feet distant southerly from the southerly curb line of the street commonly known as the Lakefront Road. The Commission shall also have the duty and power to examine and approve or disapprove any application and plans for the erection of any structure within the area aforesaid. The Commission shall make a written monthly report to the Mayor of the progress of the work done under this section.
