147.01     Establishment

Upon the concurrence of the Board of Control, as required by Charter Section 77, there is hereby established a Department of Consumer Affairs subject to the Charter and ordinances of the City and to the direction of the Mayor. The Director may appoint and employ such other officers and employees as may be necessary for the operation of the office and activities of the department.

147.02     Duties of Director

The Director of Consumer Affairs shall be responsible for and shall administer the work of such divisions as may be established in the department and shall coordinate the duties of the department with the Consumers Council Advisory Board as set forth in Codified Ordinance Section 159.01. The Director of Consumer Affairs shah work to protect consumers from fraudulent, unfair, deceptive and unconscionable business practices through monitoring and enforcement of the Cleveland Consumer Protection Code and to educate consumers and service providers as to their rights and responsibilities under federal, state and local laws. The Department of Consumer Affairs shall:

(a) Accept, investigate and, if necessary, adjudicate, in conjunction with the Law Department, complaints from consumers regarding fraudulent, unfair, deceptive or unconscionable business practices.

(b) Work cooperatively with consumer agencies, schools, media, and community organizations to educate consumers and businesses about consumer issues.

(c) Make recommendations for legislative action to strengthen consumer protection.

(d) Work cooperatively with the Consumers Council Advisory Board as set forth in Chapter 159 of the Codified Ordinances.
