There is hereby established a Department of Public Health to be controlled and administered by a Director of Public Health subject to the provisions of the Charter and ordinances of the City, and to the direction of the Mayor. The Director may appoint and employ a secretary who may be in the unclassified service and such other officers and employees as may be necessary for the operation of his office and the several divisions and activities comprising the Department, except officers and employees appointed by the commissioners of the several divisions in accordance with the provisions of Charter Section 40.

Note: Pursuant to Section 2 of Ord. The Director of Public Health shall have charge of and general supervision and control over divisions and bureaus established in the Department of Public Health. The Director shall have the power to authorize, approve and accept the rendition of voluntary services to the benefit of and without cost to the City and its citizens by medical and paramedical and other volunteer personnel. He shall have additional duties as may be required by ordinance.

The Director of Public Health is authorized to accept gifts of money, property, or services, with or without limitations imposed by the donor, that may be donated for the use and benefit of the Department of Public Health.

(a) Funds so accepted shall be placed to the credit of the particular institution in Fund 126 in an account to be designated, if the fund is limited in purpose by the conditions of the gift, as "—————————— limited purpose account"; otherwise in an account to be designated "—————————— unconditioned expenditure account".
(b) The funds deposited to the credit of the foregoing accounts are hereby determined not to constitute public funds subject to the provisions of law relating to the budget, but funds to be expended for the benefit of the named institution at the discretion of the Director of Public Health and Welfare, or in the manner and for the specific purpose named in the gift.

Expenditures from accounts shall be made on vouchers signed by the appropriate commissioner and the Director of Public Health when the amount is less than ten thousand dollars ($10,000); otherwise the expenditure shall first be authorized by ordinance of Council in the manner provided in Charter Section 108. No part of any funds so credited to the accounts shall be paid to or for the benefit of any officer of employee, either as additional compensation or as reimbursement for expenses incurred, or paid for purposes other than those directly benefiting the divisions or in any manner other than that applicable to the expenditure of other public funds, unless the payment is specifically provided for in the terms of the gift or authorized by resolution or ordinance of Council.

There is hereby established in the Department of Public Health and Welfare a Division of Health to be controlled and administered by a Commissioner of Health, subject to the provisions of the Charter and ordinances of the City, and to the supervision and direction of the Director of Public Health and Welfare.
The Commissioner of Health shall administer the Health Code and see that all ordinances and rules of the City and all applicable State laws affecting the public health are properly enforced. He shall supervise the work of the several bureaus established in the Division of Health. He shall apply to physicians in the City, who are licensed by the Ohio State Medical Board to practice medicine and surgery in all its branches, outfits for the collection of material from cases suspected to be diphtheria, typhoid fever, tuberculosis, rabies and such other communicable diseases as he may decide, and shall have such material examined and report the result of such examination to the physician submitting such material. He shall maintain and supervise a laboratory to assist in the diagnosis of communicable diseases and in fixing the period of quarantine, determine the quality of the food, milk and water supplies of the City and perform such other chemical and bacteriological analyses as are related to the public welfare.

There is hereby established in the Division of Health a Subdivision of Communicable Diseases to be administered and controlled by a Chief, subject to the direction and supervision of the Commissioner of Health. The function of the Subdivision shall be to prevent the transmission of communicable diseases, perform disinfection, establish and maintain quarantine and perform such other duties as shall be deemed necessary for the prevention and control of epidemics.
There is hereby established the office of Controller of Tuberculosis in the Division of Health. The Controller, who may be the person designated as Controller of Tuberculosis by the County of Cuyahoga, and a majority of the health districts therein, shall be appointed by the Commissioner of Health of the City, shall serve without compensation from the City and shall have and exercise all the powers and duties of the Commissioner relating to the control of tuberculosis under the supervision and direction of the Commissioner which it would be competent for a deputy commissioner of health to have and exercise.

There is hereby established the office of Controller of Chronic Illness in the Division of Health. The Controller, who may be the person designated as Controller of Chronic Illness by the County of Cuyahoga, and a majority of the health districts therein, shall be appointed by the Commissioner of Health of the City, shall serve without compensation from the City and shall have and exercise all powers and duties of the Commissioner relating to the control of chronic illness under the supervision and direction of the Commission, which it would be competent for a deputy commissioner of health to have and exercise.

There is hereby established in the Division of Health the Bureau of Public Health Education in the charge of a Chief of Public Health Education, subject to the supervision and direction of the Commissioner of Health.

There is hereby established in the Division of Health a Subdivision of Child Hygiene, to be administered and controlled by a Chief, subject to the supervision and direction of the Commissioner of Health. The function of the Subdivision shall be to foster the health and physical well being of children, and to that end it may provide such infant welfare stations, prenatal clinics, medical supervision of school children and such other means for the protection of children as the Commissioner of Health may deem necessary.
There is hereby created, in the Division of Health, Subdivision of Communicable Diseases, the position of Coordinator of Venereal Diseases, the incumbent of which shall be a person trained in public health procedure and in the control of venereal disease.

There is hereby established in the Division of Health a Bureau of Vital Statistics, to be administered and controlled by a Chief, subject to the supervision and direction of the Commissioner of Health. The function of the Bureau shall be to administer the ordinances of the City and the laws of the State on the registration of births and deaths within the City.
(a) There is hereby established in the Department of Public Health a Division of Environment, to be administered and controlled by a Commissioner of Environment, subject to the provisions of the Charter and ordinances of the City, and to the supervision and direction of the Director of Public Health.

Note: Pursuant to Section 4 of Ord. (a) There is hereby established in the Division of Environment a Bureau of Environmental Health, to be administered and controlled by a Chief, subject to the provisions of the Charter and ordinances of the City, and to the supervision and direction of the Commissioner of Environment.
(b) Notwithstanding the provisions of Sections 141.11 and 201.01 of the Codified Ordinances of Cleveland, Ohio, 1976, the Chief shall administer and enforce provisions of state and local law, ordinances and regulations relating to environmental health, including but not limited to the sanitation of neighborhoods, places of business, schools and places of recreation, such as those sections of the Health Code which relate to the inspection of food and milk, insect and rodent control, lead poisoning and exposure control, swimming pool inspection, the approval of various license applications as imposed by the Code, and the investigation of environmental health nuisances and complaints. The Chief shall keep such records as may be necessary or useful to the efficient management of the Bureau.

(a) The Director of Public Health is authorized to conduct voluntary food safety training courses in order to certify participants as being adequately trained in food safety throughout the year and to fix and collect fees from participants for such purposes.
(b) The Director of Public Health is authorized to make purchases and enter into one or more agreements under the Charter and relevant Codified Ordinances for course materials, supplies, and refreshments, and if necessary, rental of sites for the courses.
(c) The Director of Public Health shall deposit fees collected from participants in the courses into the Food Fund. The fees collected and placed in the Food Fund are appropriated for the purposes stated in this section. All expenditures made under this section shall be paid from the Food Fund and from other funds appropriated for use of the Department of Public Health.

There is hereby established in the Department of Public Health, a Division of Air Quality to be administered and controlled by the Commissioner of Air Quality, subject to the provisions of the Charter and the ordinances of the City, and to the direction of the Director of Public Health.

The Commissioner of Air Quality shall administer and enforce the ordinances of the City of Cleveland relating to air quality; confer, as appropriate, with State of Ohio and federal agencies in regard to environmental matters; plan, manage and implement divisional air program and policies; develop environmental policy recommendations; supervise the preparation of air pollution permits, including enforcement and compliance monitoring; oversee all relevant environmental issues; supervise enforcement, monitoring, permitting and information control; and perform such other duties as may from time to time be required by ordinance or the Director of Public Health.

The Director of the Department of Public Health shall charge each patient for service rendered at clinics and other health facilities operated by the City of Cleveland, in accordance with a schedule of fees approved by the Board of Control. The Director of Public Health shall also charge for the analysis of blood samples for lead performed at the lead laboratory operated by the City of Cleveland, in accordance with a schedule of fees approved by the Director of Public Health. The schedule of fees charged for the analysis of blood samples for lead performed at the lead laboratory operated by the City shall not exceed the cost of the analysis. Such schedules shall become effective upon their publication in The City Record.

The Director of Public Health is hereby authorized to employ by contract, for the purpose of supplementing the regularly employed personnel of the Department of Public Health, such expert medical consultants as may be necessary for the administration of special projects and programs by the Department of Public Health. Contracts may be made without competitive bidding, but shall be entered into only with the person or firm determined by the Board of Control, after inquiry and investigation, to be the best qualified to render such services to the City; and shall be for amounts not to exceed Twenty Thousand Dollars ($20,000.00)

The Director of Public Health is authorized to contract for professional services of licensed medical professionals as may be necessary for the administration and operation of the Department of Public Health, the clinics and other facilities under the jurisdiction of the Department of Public Health. All such contracts shall require the medical professionals to indemnify the City and provide insurance coverage acceptable to the Director of Public Health and Director of Law.
