137.01     Establishment

Pursuant to the authority of the Charter there is hereby established, a Department of Community Development, to be controlled and administered by a Director of Community Development subject to the provisions of the Charter and these Codified Ordinances, and to the direction of the Mayor.

137.02     Duties of Director of Community Development

The Director of Community Development shall administer the Department of Community Development and supervise the work of the several divisions established in the Department; administer the laws and ordinances of the City relating to Community Development; coordinate the functioning of the several divisions of the Department with other departments, divisions and offices of the City, with Federal, State and County offices and agencies; supervise the carrying forward of the development, redevelopment, renewal, rehabilitation and conservation of the City in conformity with the General Plan of the City; manage and supervise all projects undertaken by the City for the redevelopment, renewal, rehabilitation or conservation of slum, blighted, deteriorating or deteriorated areas, including the relocation of occupants displaced by this or other governmental action; make application to the appropriate agencies of the Federal government and other public bodies on behalf of the City, the Local Public Agency, for financial assistance if it is determined that financial assistance is necessary; and do and perform such other duties as may from time to time be required of him by the Mayor, or by ordinance of Council.

137.021     Homesteading

(a) The Director of Community Development shall establish a Cleveland Homestead Program within the City.

(b) For the purpose of such program, the Director of Community Development is authorized to accept, as gifts, real property on which is situated a structure which may be rehabilitated, or an undeveloped parcel of land which is suitable for the construction of a residential structure.

(c) The Director of Community Development shall prepare qualifications for prospective recipients of the Homestead Program and an outline of the procedures to be followed in the program and forward the same to Council.

(d) Notwithstanding and as an exception to any conflicting ordinance of the City, the Director of Community Development may convey real property acquired under the Homestead Program to qualified recipients by way of a deed with conditions subsequent, such conveyance being on the conditions that the structure be rehabilitated to the Building and Housing Codes of the City and that the recipient reside in the structure.

(e) The Director of Community Development is authorized to enter into all necessary contracts for the purpose of securing professional real estate appraisal, re-use appraisal, title services and such other professional services he may deem necessary to receive services incidental to the receipts, donation, sale or transfer of real property pursuant to the Urban Homestead Program.

137.022     Provision of Services for Fees

The Director of Community Development is authorized to enter into contracts with governmental agencies to provide said agencies with appraisal, relocation and cartography services, which contracts shall provide for the payment to the City of the cost of the services rendered.

137.07     Division of Neighborhood Services

There is hereby established a Division of Neighborhood Services in the Department of Community Development, which shall be administered by a Commissioner of Neighborhood Services, subject to the provisions of the Charter and ordinances of the City, and to the direction of the Director of Community Development.

137.08     Duties of Commissioner of Neighborhood Services

The Commissioner of Neighborhood Services shall administer City programs for the Department of Community Development that strengthen City neighborhoods through direct services to homeowners, tenants, merchants, and community-based institutions, that preserve dwelling units through direct loans and grants to property owners for repairs, renovations, and energy conservation improvements, that maintain safe, high-quality and affordable housing for low income households, and that provide direct social services to low and moderate income citizens of the City, including services provided by community-based institutions; and shall perform such other duties as may from time to time be required by ordinance or by the Director of Community Development.

137.09     Division of Neighborhood Development

There is hereby established a Division of Neighborhood Development in the Department of Community Development, which shall be administered by a Commissioner of Neighborhood Development, subject to the provisions of the Charter and ordinances of the City, and to the direction of the Director of Community Development.

137.10     Duties of Commissioner of Neighborhood Development

The Commissioner of Neighborhood Development shall administer City programs intended to encourage the development or improvement of residential and commercial property in Cleveland's neighborhoods; shall manage public acquisition of real estate to be used in furtherance of the City's neighborhood development objectives; shall manage and propose allocation of the City's capital resources to provide incentives for private investment in residential and commercial development within the City; shall plan and implement City programs intended to foster the construction of safe, high-quality, and affordable housing for low income residents; and shall perform such other duties as may from time to time be required by ordinance or by the Director of Community Development.

137.11     Division of Administrative Services

There is hereby established a Division of Administrative Services in the Department of Community Development which shall be administered by a Commissioner of Administrative Services subject to the provisions of the Charter and ordinances of the City, and to the direction of the Director of Community Development.

137.12     Duties of Commissioner of Administrative Services

The Commissioner of Administrative Services shall administer all activities and personnel of the Division of Administrative Services; shall coordinate departmental support for the various divisions within the Department of Community Development in the areas of personnel, office services, auditing, budgeting, accounting, information system services, compliance with state and federal grant requirements and in such additional areas as are determined by the Director of Community Development for the efficient operation of the department; and shall perform such other duties as may from time to time be required by ordinance or by the Director of Community Development.

137.13     Housing Clinic

There is hereby established within the Department of Community Development a Housing Clinic to which members of the regularly employed staff of the several Divisions of the Department may be assigned by the Director of Community Development for the purpose set forth in Section 137.14, and to perform such functions as may be necessary to implement the intent of the Housing Clinic.

137.14     Function of the Housing Clinic

The purpose of the Housing Clinic shall be to establish and administer programs to implement and carry out the intent of these Codified Ordinances, and to that end it shall deal with violators of the minimum standards set forth in these Codified Ordinances necessary to make all housing, building and structures safe, sanitary, free from fire and health hazards and fit for habitation, and beneficial to the public welfare; aid and assist in the coordination of the activities of the Municipal Court, upon referrals therefor, and with volunteers, consultants and other organizations in the City concerned with the problems of the enforcement of the minimum standards for housing and building; assemble, analyze and work with individual violators, voluntarily or upon referral, of the minimum Code requirements; enlist various social, economic, financial and medico-legal methods to insure that violators of the minimum Code requirements can comply and will be able to comply with the aforesaid minimum standards; act as a source of accurate and reliable data on the problems connected with housing and building; conduct such activities for the improvement and education of the citizens of Cleveland in order that they may better be able to comply with these Codified Ordinances; and provide such technical assistance aid and help to those individuals, corporations, or other entities referred to it, or voluntarily seeking its help.

137.15     Housing Clinic Rules and Regulations

In furtherance of the objectives of the Housing Clinic, the Director of Community Development is hereby authorized to adopt such rules and regulations as may be necessary for the conduct of the Housing Clinic.

137.161     City Demolition Contracts—Repealed

137.17     Lease Agreements

Notwithstanding and as an exception to Chapter 183 of the Codified Ordinances of Cleveland, Ohio, 1976, the Commissioner of Redevelopment may, with the approval of the Board of Control, enter into month-to-month written leases involving real property for community development lands purchased by the Department of Community Development, or its named successor departments, with Urban Renewal Bond Funds, Community Development Block Grant Funds and/or Urban Renewal Funds. However, such real property shall be located in neighborhood conservation areas, as defined in Chapter 323 of the Codified Ordinances of Cleveland, Ohio, 1976, or community development plan areas as defined in Chapter 313 through 321 of the Codified Ordinances of Cleveland, Ohio, 1976, or urban renewal project or plan areas.

137.18     Refreshments at Community Meetings and Workshops

The Director of Community Development shall have the authority to expend funds in order to provide refreshments, as necessary, at workshops, training sessions and community meetings held by the Department of Community Development in the course of administering the Community Development Block Grant Program.
