With the concurrence of the Board of Control, as required by Charter Section 77, there is hereby established in the Office of the Mayor, and subject to his direction and control, the Office of Special Audits and Investigations, which shall consist of not more than two special auditors and investigators. Such special auditors and investigators shall be in the noncompetitive class of the classified service and shall receive such compensation as shall be fixed by the Mayor within the schedule of compensation as established by ordinance.

Pursuant to the provisions of Charter Section 77 and with the concurrence of the Board of Control, there is hereby established in the Office of the Mayor, the Office of Civil Defense, to be administered and controlled by a Director of Civil Defense appointed by the Mayor in compliance with RC 5915.06, who shall serve at the pleasure of the Mayor and subject to his supervision and control. To assist the Director in the administration of the duties of his office the Mayor shall appoint an executive committee of such number of persons as he may determine necessary or desirable who may or may not hold other official positions in the governmental service of the State or any of its political subdivisions who shall serve at his pleasure. The Director, with the approval of the Mayor, shall appoint a Deputy Director of Civil Defense who shall be responsible for the distribution of the work of the Office among the several departments of the City. In addition the Director, with the approval of the Mayor, shall appoint three Zone Directors of Civil Defense, who shall serve at the pleasure of the Mayor and be responsible for the discharge of such duties as may be required of them within their respective areas as determined by the Mayor and as may be assigned to them by the Mayor, the Director or Council. Such clerical, stenographic and other necessary employees of the Office as the Director shall determine to be necessary adequately to staff the Office shall be appointed in accordance with the civil service provisions of the Charter, by the Deputy Director, with the approval of the Director. The several administrative departments of the City shall furnish upon request of the Deputy Director such members of the respective departments as the Mayor shall determine and designate.

(a) The Director of Personnel and Human Resources shall have the authority to expend funds in order to provide food, refreshments, mementos and, if necessary, to rent a site for the following:
(1) Training sessions conducted jointly with the labor unions relating to dispute resolution and other labor-related issues;
(2) Employee programs and events sponsored by the Department of Personnel and Human Resources;
(3) Meetings to conduct labor negotiations;
(4) Training evaluation meetings held by DERS trainers to review City programs in progress and discuss new programs;
(5) Events honoring employees for work-related achievements, including but not limited to, the annual employees' service award program; and
(6) Events honoring employees for raising contributions for charitable organizations.
(b) The Director of Personnel and Human Resources is authorized to enter into one or more contracts with vendors to obtain the food, refreshments, mementos, and to rent locations under division (a) of this section, payable from funds appropriated for this purpose.

The Mayor is hereby authorized to employ by written contract such professional or expert services as the Board of Control shall deem necessary to supplement the regularly employed staff of the City in order to facilitate the preparation of plans, drawings, detailed specifications and estimates of costs, and the supervision of construction of projects included in the capital improvement program as the same may from time to time be adopted. The selection of the persons or firms to furnish such expert services shall be made upon the nomination of the director of the department concerned from a list of qualified persons available for such employment as may be determined after a full and complete canvass by the official designated by the Mayor for the purpose of compiling such list. Each such contract shall be prepared by the Director of Law, certified by the Director of Finance and a written report of the execution of every such contract with an abstract of its terms shall be filed with Council forthwith.

Pursuant to Charter Section 38(j), the Mayor shall report to Council one week prior to the submission of the Mayor's Estimate, detailed information concerning the work performed, the services rendered and the capital improvements undertaken during the prior year and the proposed program of work to be performed, the services to be rendered and the capital improvements to be undertaken in the ensuing year.

(a) There is hereby established in the Office of the Mayor the Office of Budget and Management to be administered and controlled by an Executive Assistant to the Mayor, specifically appointed by the Mayor, to be the Director of this Office. The Director shall appoint, in accordance with the civil service provisions of the Charter, such assistants and clerical, stenographic and other employees as may be required for the performance of the duties of the Office, and shall be responsible for their supervision.
(b) It shall be his duty to conduct research into all phases of City government and make recommendations to the Mayor relating to its operation. In furtherance of this purpose he shall conduct a continual study of the structure of Municipal departments with respect to present and future needs, analyze budgetary requests and relate such requests to evolving community requirements, conduct a continuing analysis of departmental income and cost and correlate such income and the public need and do and perform such other services and duties as will assist the Mayor in the efficient and progressive operation of the City's government.

(a) There is hereby established a Rainy Day Reserve Fund, to which shall be credited amounts reflecting a positive budgetary balance from the General Fund as of December 31 of each year.
(b) The following principles, representing sound fiscal management, will govern the preparation of the annual General Fund budget and the maintenance of the Rainy Day Reserve Fund established pursuant to division (a) of this section:
(1) The annual General Fund budget should be prepared and considered in a prudent manner without reliance on unrealistic revenue or expenditure assumptions.
(2) The annual General Fund budget should first fully account for payment of all current liabilities including all necessary operating expenses to be incurred during the budget year.
(3) The initial budgetary goal each year should be to fully fund all current obligations so as to eliminate any year-end GAAP deficit that may exist.
(4) Consistent with divisions (b)(2) and (b)(3) of this section, the Mayor should propose and the Council should adopt annual General Fund budgets which provide for a reserve in excess of anticipated expenditures which may then be credited to the Rainy Day Reserve Fund.
(5) The Rainy Day Reserve Fund should accumulate to at least a level equal to two percent (2%) of General Fund expenditures. It should only be reduced during significant periods of economic downturn or to fund unanticipated one-time General Fund obligations. If drawn upon, the City will seek to replenish the Rainy Day Reserve Fund in its entirety during the succeeding budget year.

There is hereby created in the Office of the Mayor, the Office of Consumer Affairs, to be administered and controlled by an Executive Assistant to the Mayor, specifically appointed by the Mayor, to be Director of the Office subject to the provisions of the Charter and the ordinances of the City and directly under the supervision of the Mayor.

(a) There is established in the Office of the Mayor, the Office of Equal Opportunity to be administered and controlled by an Executive Assistant to the Mayor appointed by the Mayor to be the Director of Equal Opportunity. The Director shall appoint, under the civil service provisions of the Charter, employees required to perform the duties of the office, and shall be responsible for their supervision.
(b) According to the City's desire to encourage equal employment opportunity of minorities and women by contractors, and to promote use in all City Contracts, as defined in Section 187.01, of minority business enterprises (MBEs), female business enterprises (FBEs) and Cleveland Area Small Businesses (CSBs), all as defined in Section 187.01, when appropriate under Chapter 187 (collectively, the “Targeted Businesses”), the Director of Equal Opportunity shall:
(1) Supervise, coordinate, monitor, and enforce for all City contracts affirmative action programs and the CSB, MBE and FBE programs in the manner described in Chapter 187.
(2) Supervise, coordinate, monitor, and enforce for all City contracts, compliance with the City's equal employment opportunity requirements, including but not limited to procedures, affirmative action programs, employment goals, and other means to implement CSB, MBE and FBE participation goals, when and as specifically applicable, in the manner described in Chapter 187. All compliance functions of the various contracting, departments shall be performed in or under the direction of the Office of Equal Opportunity. The Director of Equal Opportunity shall be responsible for securing compliance by all contractors and subcontractors with the provisions of Chapter 187, as appropriate, and any implementing rules or regulations. Contracting departments shall comply with the provisions of Chapter 187 and any implementing rules or regulations of the Director of Equal Opportunity. Contracting departments shall cooperate with the Director of Equal Opportunity and shall furnish such information and assistance as the Director of Equal Opportunity may require.
(3) Provide appropriate management, technical assistance, and information to and programs for Targeted Businesses to maximize their participation in City contracts, with the assistance to include:
A. Providing assistance with the establishment, expansion, and overall development of Targeted Businesses;
B. Assisting in the arrangement of business associations among individuals, the Targeted Businesses, and other businesses; and
C. Planning and participating in training seminars to inform potential bidders of applicable programs, and business opportunities available.
(4) Serve as liaison with economic development organizations and agencies which support the development of Targeted Businesses in the community.
(5) Coordinate any City-sponsored economic development programs for Targeted Businesses.
(6) Promulgate, and revise as necessary, regulations implementing the Cleveland Area Business Program under Chapter 187.
(c) It shall also be the duty of the Director of Equal Opportunity to ensure that the City's contractors comply with applicable prevailing wage laws.
(d) By February 15 of each year, the Mayor shall file the following written reports with the Clerk of Council, and a copy shall be provided to each member of the Council:
(1) A report stating, for each City department and for the City as a whole, the percentage and total value of contracts and subcontracts performed by CSBs, MBEs and FBEs during the preceding year.
(2) Such other information related to the Cleveland Area Business Program under Chapter 187 as may be useful in evaluating the success of the program.
